Report: Justice Department Probing Durbin, Rockefeller CIA Leak

The Justice Department has launched a criminal investigation into whether Democratic Senators Dick Durbin, Jay Rockefeller and Ron Wyden leaked details about a secret "black ops" CIA satellite program last December in a move that may have seriously compromised national security, former Deputy Undersecretary of Defense Jed Babbin said on Saturday.

"The CIA made a request to the Justice Department to investigate and possibly bring criminal charges against these three [senators]," Babbin told WABC Radio host Monica Crowley. "My information is that investigation is ongoing."

Rockefeller is the vice chairman of the Senate Intelligence Committee and Durbin is the No. 2-ranking Democrat in the Senate.

Media reports on the satellite leak last December indicated that the Bush administration was concerned about public comments by Durbin, Rockefeller and Wyden and that the CIA had requested a Justice Department probe.

"The formal request for a leaks investigation would target people who described sensitive details about a new generation of spy satellites to The Washington Post, which published a page-one story about the espionage program Saturday [Dec. 11, 2004]," a Justice Department official told The Associated Press at the time.

But the same official told the AP that Justice "has not decided whether to investigate."

Former Deputy Undersecretary Babbin's comments on Saturday were the first indication that such a probe was actually launched and is ongoing.

"The fact of the matter is that [Durbin, Rockefeller and Wyden] divulged something that was above and beyond top secret and frankly, they probably blew the strategy and the hundreds of millions of dollars that were being spent to pursue it," Babbin told Crowley.

"The acknowledgement of [the "black ops" program's] existence is not even proper and the acknowledgement of them and the details of them can very well damage national security," Babbin added.

Asked if he thought the three Senate Democrats should have their security clearances revoked for the duration of the leak probe, the former Defense Department official said: "Absolutely and forthwith. I mean, they should have been revoked at the time of the leak."

"There's really not much doubt about the leak having occurred," Babbin told Crowley. "It's in the press records, it's in the Congressional record. We know what they did."

"The only question," he explained, "is how much damage was done by the leak. And that's part of the criminal investigation right now - to do a damage assessment, to figure out how much this is going to cost us strategically and militarily."

"There are indictments coming out of Justice almost every week."

Which means it's just a piece of paper to be tossed aside and forgotten unless your a Republican, then all h*** lets loose.

Kennedy and Edwards were both guilty of the same crime as Cunningham and nothing was done about them. They were both given a free pass.

Now, let's see if the outrage on this equals the outrage on the Valerie Plame case. On a scale of 1 to 100 Plame is a 9, this satellite leak is a 90.

The stupid fool did it the wrong way. When John Edwards was a Senator he "sold" his home to a Saudi Lobbyist who plunked down a $100,000 earnest money check. When he was "unable" to come up with the additional funds to buy the house, edwards kept the $100,000.

No ethics investigation and a nice $100,000 profit."

I'd probably take it one step further and say that there will be no investigation as the Justice Dept will refuse to start one.

I think President Bush has finally gone on the defensive. A year ago, I think your comments would have been spot on, but now I think he's ready to kick them where it hurts.

You make an interesting point regarding the secrecy of investigations. This has the potential to be so explosive that there are those who would weigh the cost of the truth as heavily as the weight of the crime. This isn't just about the most recent spying issue, it's the secret prison story, it's Wilson and so on.

OK, I'll be waiting. As for the investigation, let's see if it goes as far as the Valerie Plume “outing.” In any event, I'm happy something is being done against these traitors.

Did they make the comments on the floor of the Senate and that's what was picked up by the Post or did they make them some where else? If they made the comments on the floor of the Senate they are home free except for sanctions by the Senate.

You mean offence and I wish it were so but I doubt it. Agree with him or disagree I think Bush has a high regard for the office not only of President but of the Senate and Congress as well. My thoughts are that he would feel that bringing up Senators on such charges would be too damaging to the country and the institution of the Senate.

He may be right in that these are dem/socialist Senators we're talking about here and the press would go ballistic and say this was nothing more than Bush attacking and trying to silence his critics. All the dem/socialists would unite in defense of the traitors and I'm sure we could count on the usual suspects from the Socialistlight GOP moderate/RINO crowd to jump up in defense of the traitors and we would have a spectical of biblical porpotions on our hands. At the end of the day even if the evidence was overwhelming the most their treason would garner is a slap on the wrist ala Sandy Burgler.

Sorry to sound pessimistic but I think I'm just trying to be a realist.

I'm really wondering why I went to all the trouble to become an American citizen. It becomes more apparent every day the same communists are at the helm running this country that runs the UK.......namely Clinton,Gorbachev and the MSM.
I know Gorbachev as of about 5 years ago has a compound and 'Presidio' address here in CA and heard a rumour he also has one in Boston. Mousie Harry Reid is getting his attack the right-wing instructions from someone, he's not smart enough IMHO to come up with them himself.
