You're confused. But that's easy to be on this.
The judge resigned from the FISA court but NOT as a Federal Judge.
All FISA Judges are already Federal Judges, the FISA court is an additional duty they perform. So Roberts will pick a replacement from existing Federal Judges to sit on the FISA court.
And as this appointment does NOT create any vacancy in Federal Judges, Bush is out of the scenario.

Don't bother confusing people with the facts on this one. Our Dear Leader has decreed that it is good and just, therefore it is.
Its good that any United States Judge with such a poor understanding of the law should resign.

He is also 67 years old. That's past retirement age.
