Jurist Concerned Bush Order Tainted Work of Secret Panel

A federal judge has resigned from the court that oversees government surveillance in intelligence cases in protest of President Bush's secret authorization of a domestic spying program, according to two sources.

U.S. District Judge James Robertson, one of 11 members of the secret Foreign Intelligence Surveillance Court, sent a letter to Chief Justice John D. Roberts Jr. late Monday notifying him of his resignation without providing an explanation.

Charges against Hubbell's wife, accountant and tax lawyer also dropped
WASHINGTON (AllPolitics, July 1) -- A federal judge dismissed tax evasion charges against former Justice Department official and presidential friend Webster Hubbell, calling the indictment brought by Independent Counsel Ken Starr "the quintessential fishing expedition."


Throwing out the case, U.S. District Judge James Robertson ruled that Starr had overstepped his jurisdiction and that the prosecution violates Hubbell's Fifth Amendment rights against self-incrimination because immunity had been previously granted.

The judge's decision is another in a string of recent legal defeats for Starr, whose Washington grand jury indicted Hubbell last April.

The final federal court challenge preventing the Pokagon Band of Potawatomi Indians from moving forward with casino development plans was dismissed late Thursday.

U.S. District Judge James Robertson ruled that the New Buffalo area where the tribe intends to build its casino will not sustain significant negative environmental or social impact due to the development as claimed by Taxpayers of Michigan Against Casinos.

Anyone who thinks the people detained at Gitmo are POWs hasn't a clue. OBTY, I am an an attorney and a retired Marine Corps Officer. The standards for being a POW are very strict, unless you make the treaties a living document.

Which is to debase the meaning of prisoner of war. Who is the party that has guaranteed that these men would deport themselves as soldiers under the meaning of the convention?

The ruling gives the FBI ten working days to tell EPIC when it can see Carnivore records under an "expedited" Freedom of Information Act procedure. The judge scheduled an emergency same-day hearing after the suit was filed. Carnivore was recently revealed to be a method used by the FBI to tap electronic mail communications during criminal investigations. The FBI has been reluctant to reveal Carnivore details, partly on the grounds that such exposure would let programmers create their own, malicious Carnivore clones. In an application for a temporary restraining order (available as a file download at EPIC's website), EPIC charged that the Department of Justice and the FBI failed to expedite the FOIA request it submitted to the agencies last month. The judge's order was a moot point by the time it came -- the FBI and Justice Department made a last-minute concession to grant EPIC's request. At the opening of the hearing, EPIC's general counsel David Sobel told the judge he had just received the affirmative answer in a fax from the FBI and Justice Department.

It certainly says he talked to friends about it but it doesn't say if that was before it became public or after. If it was before then we have a serious breach of security by a FISA judge and he should be sanctioned

A federal judge on Monday dealt a major setback to the Bush administration by halting as unlawful the military tribunal trial of a Guantanamo prisoner accused of being Osama bin Laden's bodyguard and driver.
The judge ruled the trial could not proceed until a decision has been made on whether he is a prisoner of war under the Geneva Conventions and until the rules are changed so he can see the evidence against him and be present at all proceedings.
U.S. District Judge James Robertson rejected the administration's request to dismiss the lawsuit by Salim Ahmed Hamdan of Yemen. The ruling led to an immediate halt in the proceedings by the tribunal at Guantanamo Bay.

JUDGE RULES AGAINST FWS, CORPS IN FLORIDA PANTHER CASE - Robertson invalidates permit issued to Florida Rock for 5,200-acre mining project

A federal judge has invalidated a Biological Opinion issued by the Fish and Wildlife Service and a permit by the Army Corps of Engineers, which together cleared the way for a large mining project in habitat used by the endangered Florida panther (National Wildlife Federation v. Norton, 03-1393 JR, D.D.C.).

U.S. District Judge James Robertson's decision is "a major rebuke to federal agencies charged with protecting imperiled wildlife," said the National Wildlife Federation, which sued the service and the Corps over Florida Rock's plans to mine for limestone on 5,200 acres near Ft. Myers, Fla.

Robertson found that in its BiOp, the service "failed to ? articulate a rational connection between the record facts and its 'no jeopardy' decision and failed to provide a proper analysis of the cumulative impact of development upon the panther."

NWF attorney John Kostyack said the "cumulative effect" portion of the opinion is particularly significant.

WASHINGTON -- A federal judge on Wednesday denied a request to force the Federal Election Commission to act on complaints by President Bush's campaign against anti-Bush groups spending millions of dollars on ads in the presidential race.

District Judge James Robertson told Bush's attorneys that he agreed that the FEC had moved at a ``glacial pace'' in handling complaints, but he added, ``That's the way Congress has set it up and apparently that's the way Congress likes it.''

Can't remember the guys name but he was on Oreilly today and his last bit of spin was that Bush was "caught on tape" discussing wiretaps. I'm sure that's the next bit of talking points we'll hear a lot of.

Concerning the judge either he's been compromised in some way or he's tired of the politics and refuse to be used. Whatever the circumstance, somebody is doing a whole lot of leaking and putting people's lives at stake.

Libby, 55, was Cheney's right hand man, a powerful position in a White House where the vice president has had unprecedented power. A trial could provide the public with details about the White House's thinking as it prepared for war in Iraq.

The indictment was approved by a majority of the 18-member grand jury. While their identities are sealed, the majority of jurors were black and the majority were women, including the foreperson.

The indictment was signed by Judge James Robertson in a procedure that lasted about five minutes. Fitzgerald did not present indictment papers to judge, but let two fellow prosecutors address the judge.

Once Robertson signed the indictment, the papers were walked down to the clerk's office, where it was formally processed and the a computer randomly assigned Judge Reggie B. Walton to be the trial judge. Walton is known among defense attorneys in Washington as a tough judge. Fitzgerald said Libby would not be arrested by police officers, but is expected to turn himself in to appear before Walton for arraignment.

What does the FISA court, "The Wall" and Jamie Gorelick all have in common.

It strikes me that Bush has said several times that the procedures he has been doing as well as the Patriot Act will undo the effects of the Wall erected by Jamie Gorelick. Why was the wall erected in the first place?

I'm just trying to see the big picture. The dots don't connect for me as clearly.

they want impeachment

They do, but let them try it. The President acted within the law in accordance with the Constitution and his authority as Commander-in-Chief. If you are talking on the phone to terrorists overseas, you do not have a right to privacy and your calls can be monitored without judicial process. If the RATS go for impeachment, it will backfire on them big time.

all I am saying is - this isn't some "random" move, some heartfelt personal decision by this judge. Its orchestrated, part of the plan. and this is a bold move, to get a FISA judge to "resign" like this.

A little like a very weak "Saturday Night Massacre" ............ anything to keep the pot stirred.
