Well its now not in favor of it: what if it were worded:
DO YOU THINK THE PRESIDENT SHOULD TRY TO CATCH TERRORISTS WHO MIGHT BLOW YOU UP NEXT TIME YOU ARE THE MALL, EVEN IF HE HAS TO TAP A PHONE LINE TO CATCH THEM? Hmmmm?
I've got an even better one. If somebody in Canada mails you a package containing Tylenol w/codeine in it, and you are caught, who goes to jail? It's legal in Canada, but not in the US without a prescription.
Whose laws take precedence over your possession of a controlled substance, Canada's, or America's? Under whose laws are you charged? What about the person in Canada? Under whose laws are they charged? It is US law. The Canadian will be extradited to the US, and you are both going to jail, in the US.
I do not understand why people cannot see this. If the gov't is listening in on a conversation, where one end of that conversation is taking place in the US, then the gov't has to obey US law in tapping into that conversation. There is no grey area here.
I know. Too many folks are grabbing at straws, trying to come up with anything, anything at all, that will show that Bush didn't violate the law. I guess that we'll have to see how this plays out.
Bush could always argue that the Patriot Act gave him the authorization to do it. It does. It is unconstitutional, but it does. I don't know why he hasn't fallen back on that yet. It hadn't been ruled unconstitutional, so he could always claim that he was just following the law as it is written.

Something for consideration. Folks are referring to this as 'wiretapping', but, is it really? As I understand it, if these are calls that were initiated overseas by AQ, then, I would suspect that the chances are very good that they are using a satellite phone and link. If someone is intercepting these satellite transmissions and listening in on them - is that really considered 'wire tapping'? Not trying to parse words here (e.g., what is, is), but it seems to me if they're using this type of technology, then it's not really a wire tap. Can't satellite transmissions be picked up here an there if one has the right technology (I'm not a techie, but seems this would be feasible).
Also, when I comment on constitutional law, I do so from the perspective of 32 years practicing in the Supreme Court. For most of that time, George Bush was not President. You may reduce this to a "Bushbot" issue, but I don't.
If a communication is intercepted over the Atlantic Ocean in space, or under it from a cable, that is "international" and fair game. Others have cited chapter and verse of US law that make that clear. If you don't get it, that's your problem. Most of us do not share that excessively narrow view.

Following your logic, I've got a real good idea where the grey area is.
This is a little different, as the terrorists are targeting all of us--those who want them stopped and those who care more about partisan politics than the war on terrorism. It was a joke. Germany 1938 has nothing whatever to do with it, metaphorically, analogously, or any other way.
