Florida Judge Upholds Rush Limbaugh's Doctor-Patient Confidentiality

MIAMI, Dec 12, 2005 /PRNewswire via COMTEX/ -- Roy Black, Rush Limbaugh's attorney, issued the following statement regarding Judge David F. Crow's decision today prohibiting prosecutors from asking the talk show host's doctors about his medical treatment and condition or information he shared with his doctors during his care and treatment.

Judge Crow's ruling upholds our argument that the State cannot breach doctor-patient confidentiality just because it has obtained some medical records, and thus the state cannot ask the doctors its questions posed to the court during the hearing.

Judge Crow's decision prohibits the State from questioning Mr. Limbaugh's physicians about "the medical condition of the patient and any information disclosed to the healthcare practitioner by the patient in the course of the care and treatment of the patient."

We are pleased with the court's ruling upholding the patient's statutory right of doctor-patient confidentiality. We've said from the start that there was no doctor shopping but Mr. Limbaugh should not have to give up his right to doctor-patient confidentiality to prove his innocence.

The medical records that the State has seized and reviewed now for nearly six months show that Mr. Limbaugh received legitimate medical treatment for legitimate medical reasons. Mr. Limbaugh has not been charged with a crime and he should not be charged.

As someone who has been in Pain Management since 1996, my records are sent to Richond for the Dinosaurs on the Medical Review Board to read, in case they decide to prosecute my Doctor for prescribing the drugs I take.

It has frosted me no end that he has to do this, and I've written numerous letters to the antiquated idjits in Richmond complaining at how they punish Doctors who understand the pain that people with joint and back problems can be in but why does that make MY records an open book to the jerks?

I feel like my sense of privacy has been violated - and that is why, my friends, they ask you to sign those forms. So that if a Medical Review Board for their state asks for the records, they can just turn them over. They don't "intend" to - but they sure do, when asked.

I don't laugh at anyone's pain.

I was in 'real' pain myself, but my dentist refused to prescribe any more Vicadin (I think) because he thought I was mis-using it. Told me 4 advils do the same job.

Point is, once you make yourself spokesperson for Conservatism, you have certain responsibilities, and one of the primary being, DO NOT EMBARASS your-self otherwise you make all conservatives look like hyporcrites.

Look at Bill O'Reilly. What a joke. He writes the O'Reilly factory about Kids, always spouting about family values, offended by Paris Hilton Commercial for Carl's Junior, and meanwhile he is harrassing his co-worker in most disgusting way.

You think next Republican/Conservative cadidate would sit down with him for interview and talk about family values? Would look like a fool if they did so.

Don't feel sorry for Rush

Don't worry, the posters who are saying things like that are anything but sorry for Rush. There is a lot of hatred for Rush here on good old conservative FR, and some FReeps would like nothing more for Rush than to see him wearing stripes and leg irons. Go figure.

I used to worship Rush and then he did this. Lost total creditability with me.

What a joke.

He never...NEVER apologized for all of that - esp the remarks against the "lower people" from himself.

He has hurt the conservative moment. It is one thing to have a problem...it is another to lie about it.

You are simply full of it. I've never seen a prosecutor go after any liberal Hollywood actor for being a drug addict, nor any athlete, nor anyone for that matter.

It is pretty obvious that the criminalization of conservatism is quite ok with you.

Rush has his problems that he will have to live with, hopefully he has gone through them and beat them. But if you think he's a criminal, then how about bringning 90% of Hollywood and most rock groups in and charging them too?

If Al Franken or any other Hollywood Celebrity did what Rush did then you would be calling for death penalty.

Why would you assume that? Now if Rush's network stole $800K from a children's charity I would probably say something.

I am not. This doctor shopping law is being abused by the prosecutor. The maid was a bigger criminal, IMHO. Blackmailing and drug running is a far more serioius crime than an individual who abuses drugs, especially one who has become addicted to presription drugs. I don't look at Brett Farve as some hardened criminal either who had a similar addiction, and I am no Packers fan.

About time! I wondered where Rush was today. And when will they return his medical records in full? They have no right to dig into someone's medical records. Ever. Leave us alone with our warts and varicose veins.

So your doctor made a wise choice for you before you became addicted. Not too many doctors do that and keep prescribing these highly addictive pain-killers for way too long.
