The judge on Fox just said that the venue stays the same, the more serious charges remain, and this was a defeat for DeLay.

How about a civil suit against the prosecutor for wrongful prosecution ? Prosecutors are generally immune from such suits unlessthey were involved in the investigation and were negligent in conducting/supervising it. if earle was involved in the actual investigation, he might be open to a civil action. The big problem there is that a grand jury indicted deLay, so Earle would have a pretty good defense.

From what I have heard from DeLay's attorney, it is clear that the records will show that there was NO money laundering.
DeLay will be acquitted on the charge, IMO.

I agree with the judge from what I know. Granted there is a legal issue that may be unresolved, as to whether it is legal to exchange soft money for hard money via a third party to circumvent a campaign finance limitation.
