These morons do not even understand the distinction between the Supreme Court hearing argument on a case, and deciding a case. The Court announces in advance when it is going to hear a case -- 6 December for this one. It never announces when it is going to decide a case. (That will happen in about three months.)

I wrote one of the briefs in this case. I think the Court will uphold the Solomon Amendment and reverse the decision of the Third Circuit. If it does not do that, it means that Justices who use the Constitution for toilet paper still hold a majority on the Court. I don't think the new Chief Justice will allow that to happen.

Also, if Judge Alito is confirmed to replace Justice O'Connor before the decision is handed down, and if her vote changing would affect the outcome, then the case will be reargued, and the decision will be reconsidered with Alito instead of O'Connor in place.
