College probes teacher who urged fragging by GIs

A community college in northwestern New Jersey is investigating a part-time instructor who vowed to intimidate students who host conservative speakers at the school. The teacher also called for U.S. soldiers in Iraq to kill their superiors. At issue is a personal e-mail written by John Daly, adjunct instructor in writing and developmental English at Warren County Community College in Washington, N.J. He sent it to a student after she asked him and other faculty members to announce that a veteran of the war in Iraq would appear at the school.

The Admin has apparently offered up three responses each displaying less support for the prof than the previous one.

This afternoon I googled for the web page on Warren County Community College. When I went to it they had put up an introductory page which references all three of the College's press releases - on 11/17, 11/18, 11/19. The 11/19 says there will be a Board of Trustee's meeting on 11/22 and that that is the soonest a Board meeting can be held.
This is a free country, and Mr. Daly can express any opinions he wishes to, but pending the outcome of the meeting it seems likely that Warren College does not wish to be associated with his opinions.
This will give Mr. Daly more time to write his opus, which will prove beyond a shadow of a doubt that capitalism has killed more people than Communism.
He should find a ready market for that book on our campuses, so I hope he doesn't expect me to buy a copy.

"If someone ever siad to me what he said to this college girl, he'd be needing dentures, and quick"Funny, but I had a very similar thought the first time I read his email to Ms.Breach... except I was thinking "rifle butt" and had this instant mental image of Mr. Daly attempting to spit the blood and broken teeth out.
I think I'd like to have .jpg file of that just to give me a little smile every once in a while.

The Board of Trustees intends to consider the welfare and rights of its students, the college community, and the public in lieu of recent events. "In lieu of"?? How about "in light of" recent events? Shesh! Where was the proofreader on this one?

I wonder how serving 10 years in Federal prison for sedition would affect his tenure? Badly, I hope. I would think extreme statements regarding members of the armed forces during an undeclared war wouldn't be legally considered seditious.

I would think extreme statements regarding members of the armed forces during an undeclared war wouldn't be legally considered seditious. There are two Federal laws pertaining to sedition.
One is Title 18, Part I, Chapter 115, Sec 2388 "Activities affecting armed forces during war", which deals with sedition in wartime.
The second is Title 18, Part I, Chapter 115, Sec 2387 "Activities affecting armed forces generally", which applies here. Below is this section in question. I have highlighted the parts pertinent.
Title 18, Part I, Chapter 115, Sec 2387
(a) Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:
(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; or
(2) distributes or attempts to distribute any written or printed matter which advises, counsels, or urges insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States
Shall be fined under this title or imprisoned not more than ten years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
(b) For the purposes of this section, the term military or naval forces of the United States includes the Army of the United States, the Navy, Air Force, Marine Corps, Coast Guard, Naval Reserve, Marine Corps Reserve, and Coast Guard Reserve of the United States; and, when any merchant vessel is commissioned in the Navy or is in the service of the Army or the Navy, includes the master, officers, and crew of such vessel.
