Court: Lesson on Muslims OK (9th Circus Again)

SAN FRANCISCO - Christian students and parents cannot sue a school district where some seventh-graders pretended to be Muslims for three weeks during a course in world history, a federal appeals court ruled Thursday.

The 9th U.S. Circuit Court of Appeals said the role-playing game was not a religious exercise that violated anybody’s constitutional rights.

The decision was issued one day after the U.S. House of Representatives chastised the 9th Circuit for ruling earlier this month that parents can’t sue public schools for providing information about sex. That decision “deplorably infringed on parental rights,” said the House resolution. Thursday’s decision came down in an unpublished memorandum, indicating the judges considered it routine.

They reviewed the method used by one teacher in Byron, Contra Costa County, four years ago to teach the unit on Muslim history, culture and religion that is part of the state’s seventh-grade history curriculum.

Brooke Carlin encouraged her students to play at being Muslims - adopt Muslim names, recite a line from a prayer and give up candy or television to simulate fasting, for example. Students were permitted to opt out. On the final exam they were asked to critique elements of Muslim culture.

Jonas and Tiffany Eklund sued, along with their children. San Francisco U.S. District Judge Phyllis Hamilton dismissed the suit two years ago, saying Carlin was merely teaching and not indoctrinating. Hamilton found that the students did not engage in actual religious exercises.

The 9th Circuit upheld her decision in a five-sentence ruling, saying only that the activities weren’t “overt religious exercises” that would raise concerns under the First Amendment prohibition of “establishment of religion.”

Senior Circuit Judge Dorothy Nelson of Pasadena and Circuit Judges Johnnie Rawlinson of Las Vegas and Carlos Bea of San Francisco signed the decision.

There are, I believe 3, bills before Congress now, to dissolve the 9th circus, divide it into either 2 or 3. Needless to say, the libs are fighting it tooth and nail!!

But my idea is this. Law #1: The 9th circuit is dissolved, you're all fired. Law #2: There is a new 9th circuit and 10th and 11th. We're looking for fresh-faced judges. The fired ones pretty much should forget about applying, unless they are Janice Rogers Brown.

Part of the problem with the underlying subject of this story is that the main point is never discussed or debated, and the idiots who made it possible never identified.

I would start with the teacher who can't tell the difference between learning cultures and indoctrination.
Next is the Principal who allowed it.
Then the school board, which presumably agreed by acquiescense.
Then there's the State Education idiot who dreamed up the exercise.
Then there is his/her boss who saw nothing wrong with it.
Then there are our lagislators, who are too busy, mostly, funding gay parades and other abominations to deal with what, were it any other religion, would be considered an egregious intrusion of religious indoctrination into the educational process.

Finally there is tis string of judges mentioned in the absurd decision.
There are plenty of heads, just ready for rolling... and deservedly so.

I wonder, did his lesson plan include having a "Muslim" student behead a Jewish or Christain student. If the 9th Circus is going to support this kind of thing, perhaps we can force the schools to teach the true face of Islam.

I understand, however they have lifetime appointments...they can not be easily removed...but congress can fairly easily dilute them.

I've seen this coming since 2001--when all of a sudden it was seemed necessary to "understand" islam. In my daughter's elementary school, there is a map of the world, with arrows pointing to different places some of students parents originated from. One arrow points to Israel, and reads "Palestine". Nice, huh...no indoctrination here, right?

If Congress had some guts they could remove them.

There are certainly solid grounds to do so...but it would be a fight...and, of course, Congress doesn't have any guts.

Does anyone really listen to anything these idiots say anymore? Everything they do gets overturned. As far as those advocating leaving the state, I'd rather stay and fight instead of run away, because liberals are everywhere, and they won't stop just because you move to another place where there is less of them. They tried to stop us from homeschooling my eldest, and we fought back and won. My youngest is in a Christian private school where this kind of nonsense doesn't go on. I will not let idiots run me out of my home.

I guess this is the left's answer to ID: Steath Islam as opposed to stealth Christianity.

Well, well, well - if the students are pretending to be Muslims does the school have courses on bomb, IED, poison gas building and use?

If not - how can they have a course on Islam without these timely issues?

Dare I ask what the school course had the kiddies do in emulation of Big Mo's choice in wives? ;-)

Greencastle PA not only has town-sanctioned "Greencastle Christmas Heritage" banners flying blatantly on every lamp post, they're also having an audaciously bold-faced *Christmas* parade.

I expect the rebellious little hamlet to be invaded by disgruntled ACLU mobs at any second....:)

Regarding the article...did any of the kids duct-tape C3 around their bellies and blow up any teenage infidels?

'Convert' any 12 year olds at sword point?

Stone to death any girls whose blouses allowed their midriffs to be exposed?

[gotta keep it real ya know]

p.s...the SA bell ringers are out already.

I stuffed some money into the new and annoyingly deformed "new style" slot of the guy's kettle and he thanked me.

I said "Merry Christmas!" and I thought the guy was gonna go gaga on me.

He started laughing and carrying on and kept it going as he followed me clear over to where hubby had the truck parked, waiting.

I swear, those two little words gave the man wings.

It must tear them up to be so effectively gagged by the PC Nazis.

I found myself having terribly conflicted feelings.

There was the joy of giving to a good Christian cause and nestled up against that, the utterly black-hearted loathing of those who censor the people standing out in the freezing cold to receive the gifts.

Oh yeah.
I can see already that hubby and I are gonna be really ramping up the obnoxiousness of our usual "culturally offensive" Christmas anarchism.

I can hardly wait...>:-]

Everything they do gets overturned.

Actually, about 1 case in a thousand gets overturned. That's a fraction of a percent. Hardly "everything".

Any law says you can't cut their pay?

You kidding?

The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.
Sound familiar?
