Snatching Defeat from the Jaws of Victory

I wrote Monday that late last week, the Senate — after a year-and-a-half of fiddling while Rome burned — had finally acted to bar al Qaeda terrorists detained in Guantanamo Bay, Cuba, from using the courts of the American people as a weapon in their war against the American people. Well, when it comes to the Republican-controlled Senate, such lauding is always done at one’s peril. The ink was not yet dry (or the online equivalent) on that article when our distinguished senior legislators struck another of their craven compromises.

Last week’s 49-42 margin demonstrated that the votes were there to win. Nevertheless, the chamber has now reversed itself. By a vote of 84-14, the senators resolved Tuesday that the ultimate decision about who is properly considered an “enemy combatant,” should rest with federal judges, not our military commanders who actually confront the enemy in the life-and-death of the battlefield.

Snatching defeat from the jaws of victory, Senator Lindsey Graham chose to make common cause with Senate Democrats, led by Senator Carl Levin, who favor treating the people trying to annihilate us as if they were ordinary criminal defendants. Yes, the military commissions favored by the administration will go forward — at least for now. But the compromise would allow any prisoner who received a sentence of ten years or more of imprisonment (including death) automatically to appeal to the U.S. Court of Appeals in Washington. The civilian courts will have the final say.

This is sickening, just sickening. Why is it that these spineless wimps think that giving enemies access to the courts is a GOOD THING???

I hope the military commanders see this and interpret as "dead guys don't go to court".

He can't be trusted and should therefore be turned out of the Senate and replaced by someone who can. Of course he is just one of a growing number of Republicans with no spines. I suppose the MSM with their lame polls have spooked even a few Republicans who were once somewhat sensible.

It's only fair. The Dems used to compromise ALL the time when they were in power. (yes, it's sarcasm)

The Reps act like a woman in an abusive relationship, trying to please her boyfriend so that he doesn't go off on her again.

Exactly, and I was a fool to think that 9/11 had finally changed things. They're not only back to where they were on 9/10, but they're worse. Hagel undercutting us and Jay Rocketfeller blabbing US war plans to Syria, thereby endangering not only our homeland but our troops going into battle. God help us.

On the other hand, it would be NICE if President Bush would finally have the guts and courage to veto this bill. Just exercise your veto pen AT LEAST ONCE in your presidency. As much as I detest the Senate Repukes for passing this bill, I am equally upset that President Bush will bluster & threaten about vetoing this bill....but will he have the guts & courage to actually do it. I personally think he will wilt & cave at the end, and then he will be equally complicit in passing this POS.

I hope not. Our only hope is that he now knows that not only the Dems are out to screw him, but most RINOs as well. He needs to use the bully pulpit each and every day and tell the American people their lives are being endangered by legislation like this. It's a message that will resonate.

Lott is whining and I think he's still smarting over losing his leadership position. He was a poor leader IMO (though Frist is making him look better). I agree he was screwed by the MSM over his remarks about Strom, but that's in the past. He should be a loyal trooper not, not a whino.
