Could this be the way they've chosen to fillibuster the Alito nomination? Essentially, they could shut down the Senate indefinitely in order to block Alito. I think it could be. Someone needs to let Sandra Day O'Connor know she needs to go home to Arizona and not wait all this out.

Turbin Durbin saying the pubbies had a chance to stop it before the second was made. He said the dim staff told the pub staff, the pubs did not stop it.So the Dims are backpedeling already? That didn't take long. Whine: The Pubs didn't stop us. They should have stopped us. End of Whine.

It was Durbin who immediately seconded Reid's motion. The republican senator presiding over the senate didn't call for a vote. Maybe on this procedural Rule # 21, it isn't necessary. Of course Reid and Durbin (and the rest of the dem leadership) planned this stunt to catch Frist unaware.
CNN Bob Franken said the democrats have succeeded in grabbing the headlines away from the President's statement on Avian vaccine.
Piggy Boy Durbin 2nded the motion? He had some self-satisfied little smug smile yesterday on Fox. He should be dragged out of the Senate Chamber by his tie, down the front steps of the Senate and onto the street, have his pants pulled down and sodomized by Iraqi rape room survivor wearing a strap on.

Durbin says they will shut down the open session every day until they get their way. Why not give them their investigation? IF the congressional Pubbies can show some aggressiveness it should be simple to show how absurd the notions are that:
- There was a white house "smear campaign". (What kind of campaign consists of passing comments to only two or three reporters?)
- That the extravagant liar Joe Wilson is a "whistle-blower".
- That Valerie Plame, or her husband, was protective of her cover.
In fact it may be that the 'Rats are only clamoring for this investigation on the presumption that Republicans will NOT go along with it. If the Pubbies said, "Sure!" and appeared eager the 'Rats might backpedal.

"YOu got it just right!!!!! The main campaign line of 2006 and 2008 will be democrats saying Bush fooled them into voting for the war by manipulating intelligence."
They can say that all they want, but the fact still remains that they were making these claims even before Bush was president. Heck, it was only two days after Bush's Inauguration that Clinton's Sec of Defense (Cohen) wrote an op-ed for the NY Times (along with several other columnists other than Miller), warning Bush that Saddam was both rebulding his weapons factories and reconstituting his WMD material. I can't believe they actually think they are going to get away with this when all these quotes and stories are on record.

"I don't know when I have been so mad, and I want the Republicans to fight back and beat the living hell out of the Democrats."
My local councilman showed up on my doorstep a week ago to ask for my vote, and to put a sign up. He said, "I remember that you hate all Democrats" ... lol... We hadn't talked very long that day a couple years ago, but it had the right impression.

I take it that you are not aware that judicial review was a standard practice before M v M? It had been done in state courts ala Rutgers v Addington and in the USSC Hylton case (Carriage Tax) both winning sides were argued by Hamilton.
Without judicial review the SC is essentially meaningless since Congress could enact any law it wished without regard for its constitutionality.
