That's not what I heard Frist say with my own ears this morning in an interview. He told Tony Snow that he had spent a large part of the morning with Alito; that he is highly qualified, and that if the other side filibusters, he is ready to invoke the constitutional option AND he HAS the votes to do it!

My read is that question is 100% dependent on Specter.
If Specter chooses to oppose Alito, even mildly, not only is Alito toast, but the Nuke/Constitutional option will fail to gain the votes needed.

Flawed reasoning, Rodney. You use an assumption, rather than fact, that Miers was/is a fundamentalist moderate, and compound your error by extending that assumption to a preference of your assumption over another of your assumptions. Is it your interest to keep trying to foster a divide ?
