Some observers say that Alito cannot be easily pigeon-holed. In Saxe v. State College Area School District, Alito, writing for the panel, argued that the school does not have the right to punish students for vulgar language or harassment when it doesn't disrupt the school day. "Sam struck that down as a violation of free speech," Kmiec says. "That's not a conservative outcome."

Why is that not a conservative outcome?

Talking about the Gang of Fourteen now on Fox & Friends... Can we count on the RINOs among us when the chips are down?

I think so, and some DEMs too.

The GOP has to take control of framing the debate. THe DEMs have heretofor been successful at tframing the debate as issues advocacy. The GOP needs to redirect that, so that the people realize the COurt is going to be LESS likely to make decisions relating to social structure, so that the people can make social issue decisions, working through their legislatures.

WASHINGTON -- President George W. Bush is nominating Samuel Alito to the Supreme Court, The Associated Press has learned, choosing a long-time federal judge embraced by judicial conservatives to replace retiring Justice Sandra Day O'Connor.

Bush plans to announce the nomination at 8 a.m. EST, the officials said.



The officials, speaking on condition of anonymity because they were not authorized to preview Bush's remarks, said Alito was virtually certain to get the nod from the moment Miers backed out. The 55-year-old jurist was Bush's favorite choice of the judges in the last set of deliberations but he settled instead on someone outside what he calls the "judicial monastery," the officials said.

Bush believes that Alito has not only the right experience and conservative ideology for the job, but he also has a temperament suited to building consensus on the court. A former prosecutor, Alito has experience off the bench that factored into Bush's thinking, the officials said.

Good, I hope for a miracle on Alito and it goes to a vote and passes, even if by only 51-50.

I fervently hope that the pundits just shut up for a while. I must admit, I don't think Kristol will be happy with this announcement, since it seems to make most conservatives happy.

Good morning....just wondering..did you happen to see the piece in yesterday's NY Times editorial section about Luttig's opinion upholding, to some extent, the idea of a "super" stare decisis?...Could be what doomed his chances..worth reading.

Let's see how many bridges the pundits are willing to burn. I'd guess they finally jump on the bandwagon. If not, here is where I think they'll complain.

I seriously doubt there will be complaints from Coulter, Frum or Krauthammer. I was mocking the Miers-supporters.

We're dealing with people who have said (SAID, mind you) Breyer and Ginsburg are moderates.

Would anyone out there be able to photoshop Alito's profile onto this photo and edit the title to call it "Scalito's Way?" I get the feeling that a graphic like this will get a lot of attention in the next weeks.
