Special Counsel Patrick Fitzgerald is planning to call Vice President Dick Cheney as a witness in the trial of Lewis Libby, the DRUDGE REPORT has leaned.
But the high stakes move could result in an executive privilege showdown between the White House and Fitzgerald, a top government source said Sunday.
"If Mr. Fitzgerald is going to demand a public recounting of conversations between the vice president, or even the president, and his staff, on matters he, himself, has acknowledged are 'classified,' executive privilege will obviously be invoked."
Fitzgerald has made it clear to lawyers involved in the case that he prefers Cheney appear as a witness in open court.
"Mr. Fitzgerald is starting from the position that this should not be done on remote or videotape," the well-placed source said.
Fitzgerald and Libby's attorney Joseph Tate discussed possible plea options before the indictment was issued last week, TIME magazine reports in new editions. But the deal was scotched because the prosecutor insisted that Libby do some "serious" jail time.

This is an out of control prosecutor.
Cheney has the right to tell his Chief of Staff anything he wishes, but the prosecutor is not entitled to those private communications.
I hope that Cheney claims executive privilege, something that Clinton did repeatedly for 8 years and even made new rules in order to claim the privilege.
Fitz is going to want to call everyone he can in the WH as a witness. We have a looooooong time before any trial begins. Not to mention the issues that are going to arise when reporters and CIA employees are called to testify.
The special prosecutor has spent a lot of money and he hasnt got squat. He believes if he can put something over on Cheney the Dims wont feel so badly because he didnt find anything wrong, so he goes for this bit of drama.Cheney should tell him to GFH like he told Leahy.
He already has the notes from the meeting where Cheney briefed Libby on this. This is a pure political play. Anyone who tells me they don't think Fitzgerald is in the bag for the Dems after seeing this, is nuts.
Clinton testified at the White House on video, Cheney will do the same.
