PROSECUTOR PLANS ON CALLING CHENEY AS WITNESS IN OPEN COURT; EXECUTIVE PRIVILEGE FIGHT LOOMS

Special Counsel Patrick Fitzgerald is planning to call Vice President Dick Cheney as a witness in the trial of Lewis Libby, the DRUDGE REPORT has leaned.

But the high stakes move could result in an executive privilege showdown between the White House and Fitzgerald, a top government source said Sunday.

"If Mr. Fitzgerald is going to demand a public recounting of conversations between the vice president, or even the president, and his staff, on matters he, himself, has acknowledged are 'classified,' executive privilege will obviously be invoked."

Fitzgerald has made it clear to lawyers involved in the case that he prefers Cheney appear as a witness in open court.

"Mr. Fitzgerald is starting from the position that this should not be done on remote or videotape," the well-placed source said.

Fitzgerald and Libby's attorney Joseph Tate discussed possible plea options before the indictment was issued last week, TIME magazine reports in new editions. But the deal was scotched because the prosecutor insisted that Libby do some "serious" jail time.

Why is Kerry still in the US Senate?

Pardon the overused expression, but Cheney has more gravitas than any human in this country perhaps. He is smart, confident and has been playing in the big leagues for years. Just because he doesn't want to be out front, i.e. the President, he is NOT the weak link in the Administration. He is more than a match for Fitzgerald.

I'm not sure what you mean. All I'm saying is... The Whitehouse asked the Justice Dept. to investigate this Plame B.S. and IT is nothing. The PROCESS is everything as is the way lawyers see everything.

By comparison... Sandy Burger steals secret documents from the national archives and the Whitehouse asks the Justice Dept. to go easy on him for the benefit of Clinton!

Our good friend Dick Cheney's Chief of Staff and maybe even Cheney, himself are jeopardized by the IT that is nothing, while Sandy Burglar is now going to coach the new TV series to help Hitlery get around campaign finance laws!!!

What do you mean by "60 Rep to 2 Dems?" There are 60 Reps in the Chicago area in the first place! (so to speak)(grin)

In some ways, it's worse (politically) than my city.

I don't even think a nominally Republican, extremely liberal member of the GOP-a la Bloomie-could win office there.

Alhough, Chicago does have one of the best PW chapters.

I only saw bits and pieces of it, not enough to really make a judgement. I don't think he has a prayer of getting Cheney to appear, and the attempt is just plain silly.

It seems quite plain the guy wants Cheney in the worst way. There was no crime by Libby, but he still thinks Cheney is exposed. B.S.

I actually don't think the prosecutor is interested in Cheney anymore. I think he needs Cheney to relate the brief discussion he had with Libby to prove the charges.

I think the media want Cheney in the worst way.

This is an opening ploy to get Libby to plead. Since they wouldn't offer him no jail time before the indictment, he should just drag this out until he can be pardoned.

If I were Libby I might just call witnesses that had seen Plame refered to as Wilson's CIA Spouse, by Wilson. Evidently this had been taking place for years before Libby became involved.

Then if I Libby, I'd put the special prosecutor on the stand and demand to know why he didn't discover this in his first week of investigations, and avoid his little fishing expedition.
