Fall Of A Vulcan (Time claims Libby plea deal failed over demand for serious jail time)
Time ^ | Sunday, Oct. 30, 2005 | MICHAEL DUFFY

Posted on 10/30/2005 9:25:53 AM PST by gondramB

Although Fitzgerald has so far drawn a tight circle around Libby that may leave President George W. Bush's longtime alter ego, Karl Rove, bloodied but secure, the United States v. I. Lewis Libby has already reopened old wounds about why the U.S. went to war in the first place. In an unprecedented and awkward fashion, the case pits government officials against the reporters who cover them. And Fitzgerald's indictment sets the stage for either a trial next spring or a plea bargain that almost certainly would mean jail time for Libby. That possibility has already been discussed: a source close to the investigation told TIME that Fitzgerald and Libby's attorney Joseph Tate discussed possible plea options before the indictment was issued last week. But the deal was scotched because the prosecutor insisted that Libby do some "serious" jail time.

This is a paragraph in the middle of a long article that Drudge is focusing on. Time doesn't say what their source was - it's either a leak or it's from Libby's side or it's a fake story. Why would Libby's side talk about this?

If it's an intentional leak by the Prosecutor's office, it's pretty dirty pool.

I have already decided on one new years resolution: to quit reading anyone who often says "anonymous sources say" or "a source lose to..........." says, etc.

Those "sources" should leave their cushy government jobs with their cushy government pensions and go work for the trash hauling companies - at least they would not have to change professions.

Time Magazine is that hackwork that asked if Rush Limbaugh was "good" for America and yet called the Unabomber a mad "genius".

They altered the cover shot of Rush (as USA Today recently did to a photo of Condi) to make him appear more evil.

Who cares what these Rat trash talkers have to say about ANYTHING.

They assert that Karl is "bloodied" by this non-scandal and want to expose the "bigger" issue of why we went to war in Iraq.

How about uncovering who sent Joe Wilson and why?

How about uncovering who forged the National Guard memos in an attempt to steal the 2004 election?

What a worthless journalistic endeavor. It doesn't even make good fishwrap.

"Those "sources" should leave their cushy government jobs with their cushy government pensions and go work for the trash hauling companies - at least they would not have to change professions."

The main thing that surprised me about the Plame situation was how high level administration officials were really sources for such liberal media outlets... that was real news.

As for not reading poorly sourced stories, it would be a lot easier if they had a disclaimer in the first paragraph.

No serious jail time eh? I guess foul-up Fitz should have asked for casual jail time.

I did learn one thing from this article - Libby is a Vulcan and Vulcans have some special talents:

Vulcan Nerve Pinch & Mind meld:
Mr. Spock popularised the Vulcan Nerve Pinch. This manoeuvre renders most humans and humanoids unconscious by applying pressure at pressure points at the shoulder, neck or faces of humans. Watch out Pat!

Yep, what an odd title... that's why I added a long alternative subject instead of a barf alert.

Everything about this is dirty pool.

Still, this was an honest admission: "In an unprecedented and awkward fashion, the case pits government officials against the reporters who cover them."

The case, such as it is, really comes down to whether the reporter's version or Libby's version of certain events is to be believed. But the whole problem is with reporters having this much importance in the first place. Ever since Watergate, they have felt that they were the ones in charge, and the subjects of their stories were merely fictional characters whose actual purpose was to carry out the "policies" of the reporter in question.

Plus Drudge makes it sound like Fitz rejected a plea deal from Libby's lawyer (which may be true), but Libby's lawyer also rejected a deal Fitz because of the slammer time involved.

If I couldn't get a plea with no jail time, and I was Libby, I'd go to trial, call every reporter with a connection to this case (including Pincus and Kristof who used Wilson as an anonymous early on), I'd call the CIA to see if Plame was "convert" and what they were actively doing to protect her identity (including letting Wilson write an article in the NYT and not making her husband sign a non-disclosure for his trip)....and by the time things really get going, I'd pray for a pardon in Jan 2009 before it gets to the point of serving anytime (if guilty).

One hard-to-kill Libby favorite: the irresistible tale about how 9/11 mastermind Mohammed Atta had met with an Iraqi intelligence agent in Prague five months before the hijackings.

Seem to remember the Czechs still believe the meeting took place.

I`ve emailed Time`s letters to the editor, here`s my text:

RE: Fall of a Vulcan by Michael Duffy

The only way one cand describe this story is one by the Lie By Omission.

1.Plame`s name was well known inside the beltway for years.

2.Various media giants themselves filed court documents maintaining no laws were broken in printing Plame`s name. They even admit,in court,Plame's identity as an undercover CIA officer was first disclosed to Russia in the mid-1990s by a spy in Moscow.

3.Plame`s name was also listed in America`s Who`s Who under Joe Wilson`s name ! : " Valerie Elise Plame, Apr. 3, 1998," in the 2003 edition and all editions from 1999 to the year 2005.

4.In defiance of Federal anti-nepotism laws,Valerie Plame lobbied intensifly to get her husband hired to enquire about the Niger/Iraq yellowvake.Knowing her husband was an extreme left-wing partisan. In his book, Wilson wrote: “Valerie had nothing to do with the matter. She definitely had not proposed that I make the trip.”

5.The CIa did not have Wilson sign a confidentiality agreement.Wilson promptly spewed his lies to a willing dominant left wing media.

6.The Senate Intelligence Committee was unanimous in contradicting Wilson`s op-ed propaganda piece: " the possibility that Iraq had approached Niger to purchase uranium."

7.An independent British commission, which reviewed the intelligence behind the Iraq-Niger uranium claim, concluded that the president’s statement was “well founded,” and the Senate Intelligence Committee concluded that “a number of intelligence reports” contained similar information.

8.There are WMD`s in Iraq to this day.Anyone with access to a internet search engine can type in the Iraqi city name of Al-Tuwaitha and see that there are 500 tons of Uranium there.1.5 tons of it highly enriched.

9.Victoria Toensing ,one of the authors of the 1982 Intelligence Identities Protection Act,of which this whole prosecution of Fitzgerald`s is predicated upon has stated said law was not violated.

10.And finally,Special Prosecutor Fitzgerald has a penchant for targeting Republicans. So far indicting 62 of them to only 2 Democrats.

Have we ever seen a response from the CIa on this - it seems really odd.

i don't understand. i would appreciate it if a lawyer would decipher some of this stuff. the guys over at powerline haven't posted much on this and i NEED to understand what is going on.

1. hasn't matt cooper already refuted this article, by saying that all libby did was say, "yeah, i heard that too"? if so, how can they use such a statement against him?

2. read john podhoretz's nypost column today and comment. it sounds as if there is no "there there," but this time article makes it sound as if it's a big terrible deal. which is right? i heard some other prosecutor (supposedly significant) saying this indictment is really bad for libby because he's going down for the evidence.

3. isn't all this leaking from the prosecutor's office a crime? why is no one talking about THAT? if true, where the he-- is our side in yelling about it?

4. if this IS a very narrow thing to prove, why the HECK is everyone, including fox news, intoning that MORE IS COMING, even though the prosecutor himself said it's pretty much closed???

HELP!!! LAWYERS, PLEASE EXPLAIN!

The biggest problem with this whole article is TIME's assertion that this case has "revisited" the issue of why we went to war. IT DOESN"T. EVEN Fitz said that. THis is a case of someone allegedly lying to a GJ and FBI about converstations they had with journalists about a "supposedly" covert CIA employee in retaliation for an editorial about the war written by her husband.
(1) SHe wasn't covert so no law was broken
(2) Wilson's editorial has since been discredited NOT by the WHite House but by a by-partisan Senate committee and therefore, Wilson's "contribution" to the argument about the Iraq war is irrelevant.

The "tie-in" to the war with this case is OVER. It's time for Time to be intellectually honest here! I know..that's asking too much

I am embarrassed to say that I am a TIME subscriber. I just emailed them also. I told them how excited I was that the media are finally going on trial right along with Scooter. Finally, we Americans, will get to see what liars those in the MSM actually are.

Matt Cooper will be forced to tell the truth about everything- including the conversations he had with his Democratic party adviser wife.

Oh this is fun. Finally- the blogs will get to completely out all of the liars in the MSM.

"has already reopened old wounds about why the U.S. went to war in the first place."

Exactly what the MSM wants! Not to mention some of the bureaucrats in the CIA. I tell you what, it's reopened old wounds about how some people in Washington and in the media can't be trusted. And that is a problem.
