Fitzy was right when he said if he's sent to catch a bank robber and he finds the guy embezzled as well, he will charge him with embezzlementIn your scenario, Libby certainly is NOT the bank robber, I presume.
In fact, Libby would be more like the innocent bystander who jaywalked in order to get out of the way of the fleeing armed bankrobber, and THEN WAS CHARGED with public disorder by the zealous prosecutor.
