Here's my contribution to the post-Miers discussion. Whether it is Judge Brown or some other woman judge, I feel strongly that this time the President will not make any effort to avoid a fight, but will put up a hard-wired judicial conservative.

The President needs to get back to basics. He needs to pick the most qualified legal mind he can find that believes the Constitution can only be amended as specified in the Constitution -- not by nine black robed individuals. I know there are several women who meet the latter part of that requirement but there are also scores of men who do so. I hope the President nominates Luttig and maybe Ruth Bader Ginsberg will resign in protest that he didn't nominate another Sandra "Nightfalls on the Constitution" O'Connor.

But why do we INSIST that we need a WOMAN ?
Why not nominate the BEST candidate regardless of gender or ethnicity ?
That has always been my point.
This fixation on diversity and affirmative action isn't going to get us the best justice.
Let us not reverse the issue. FIRST, determine the criteria for the best SCOTUS justice, THEN nominate the best person you can find who will fit that criteria.
If it happens to be a woman, GOOD. If not, GOOD anyway.

All federal officials take oaths to protect and defend the Constitution, Executive and Judicial officers of the states, as well as State legislators, are also required to take oaths to support the *federal* Constitution. Those are likely even more honored in the breach than the oaths taken by federal officials.

You're not getting JRB this time out. Bush could not afford to do so. Frankly, were Bush to give you what you want in return for helping inflict the death of a thousand cuts on Harriet Miers, he would be rightfully scorned by the American public as being a castrated wimp.
My bet: he appoints Hillary Rodham Clinton to the court, to do two things: (1) say "F*** you very much" to Frum, Will, Coulter, Ingraham, and the other professional pundits, and (2) remove her from the chessboard for the 2008 election.
