Operation Rescue renews its call for Miers’ withdrawal

Washington, DC – The highly esteemed Judge Robert Bork weighed in yesterday on the controversial Supreme Court nominee, Harriet Miers. Miers has been under scrutiny in the past week for having no paper trail or judicial experience.

Former Federal Judge Robert Bork, whose nomination to the Supreme Court was rejected by the Senate in an historically contentious battle in 1987, described the choice of Miers as “a disaster on every level.”

Bork, considered the perhaps finest intellectual mind in the legal community, joins a growing number of conservatives expressing concern over the Miers nomination and asking for her withdrawal from consideration to the Supreme Court.

Operation Rescue President Troy Newman said today, “As more influential conservatives are recognizing Harriet Miers to be the wrong person for the Supreme Court, we once again call upon her to give evidence of her sound conservative judicial philosophy or withdraw her name from the confirmation process.”

“We emphasize that the conservative opposition to Miers nothing personal against her. It is about Bush keeping his promise to the American people,” said OR spokesperson Cheryl Sullenger. “Our message to President Bush is very simple: Miers is a question mark to us. We need an exclamation point.”

President Bush’s nomination of Harriet Miers should be withdrawn immediately with full apologies to every outraged conservative. Does he owe it to a crony unknown from Texas or to the very people that went door to door and supported his election and reelection to the presidency? Personally I think he's drunk on power...one only needs to look at federal spending and growth of government.

Slouching Towards Miers: Bush shows himself to be indifferent, if not hostile, to conservative values.

I lost most of my respect for Bork, when he came down on the side of the anti-self-defense folks with his interpretation of the 2nd Amendment. Glad he's not on the court...

I haven't lost any respect for Robert Bork over the issue of the 2nd Amendment (we don't even know where Harriet Miers is on that one either!) and I'm bothered by the fact that you agree with the outcome of his hearings before the Senate when he faced the likes of Biden, PAW, ACLU, NARAL, and the bunch.

I hadn't until I read this piece this morning. It is over the top and unworthy of serious consideration.

P.S., obviously you haven't read Slouching Towards Gomorrah in which he comes down heavily in favor of gun ownership and relied upon the works of people like John Lott who wrote an amazing book on the issue.

How is it over the top? If you didn't give it any "serious consideration," perhaps we can just assume that means you didn't read it anyway. It amazes me how many so-called conservatives show their true colors now...basically just patsies for a President that is "hostile" to conservative values and has presided over the largest expansion of government in history.

I heard a clip on FNC from Bork today speaking on the Miers nominee - only caught part of it but sounded, well brutal.

If you could see how I voted in the Freeper poll on Miers, you would know that I haven't ever backed her. I wasn't commenting on the nuts and bolts of your article. Just about Bork.

I am in general agreement with you, CCF, on Robert Bork and Harriet Miers (and Ann Coulter!).

But who came up with the title, "Bork 'Borks' Miers"?

To my understanding, the word "Bork" is synonymous with "smear," that is, to slander. I don't think the word applies when the criticism is factual and logical, as Bork's is regarding the Miers nomination.

"There is, to say the least, a heavy presumption that Ms. Miers, though undoubtedly possessed of many sterling qualities, is not qualified to be on the Supreme Court. It is not just that she has no known experience with constitutional law and no known opinions on judicial philosophy. It is worse than that. As president of the Texas Bar Association, she wrote columns for the association's journal. David Brooks of the New York Times examined those columns. He reports, with supporting examples, that the quality of her thought and writing demonstrates absolutely no "ability to write clearly and argue incisively."

The administration's defense of the nomination is pathetic: Ms. Miers was a bar association president (a nonqualification for anyone familiar with the bureaucratic service that leads to such presidencies); she shares Mr. Bush's judicial philosophy (which seems to consist of bromides about "strict construction" and the like); and she is, as an evangelical Christian, deeply religious. That last, along with her contributions to pro-life causes, is designed to suggest that she does not like Roe v. Wade, though it certainly does not necessarily mean that she would vote to overturn that constitutional travesty."

. . .

"Some moderate (i.e., lukewarm) conservatives admonish the rest of us to hold our fire until Ms. Miers's performance at her hearing tells us more about her outlook on law, but any significant revelations are highly unlikely. She cannot be expected to endorse originalism; that would alienate the bloc of senators who think constitutional philosophy is about arriving at pleasing political results. What, then, can she say? Probably that she cannot discuss any issue likely to come before the court. Given the adventurousness of this court, that's just about every issue imaginable. What we can expect in all probability is platitudes about not "legislating from the bench." The Senate is asked, then, to confirm a nominee with no visible judicial philosophy who lacks the basic skills of persuasive argument and clear writing." --Robert H. Bork

(we don't even know where Harriet Miers is on that one either!(2nd amendment)

Uh yes we do.

"The same liberties that ensure a free society make the innocent vulnerable to those who prevent rights and privileges and commit senseless and cruel acts," Miers wrote in Texas Lawyer when she was president of the state bar. "Those precious liberties include free speech, freedom to assemble ... access to public places, the right to bear arms and freedom from constant surveillance.

"We are not willing to sacrifice these rights because of the acts of maniacs," she concluded.

After reading post after scurrilous post from the Orcs about Bork allegedly wanting to abolish Second Amendment rights, I grabbed my copy of "Slouching Towards Gomorrah" and found this passage at p. 167, after Bork denounces gun control as "frivolous":

Gun control proposals are nothing more than a modern liberal suggestion that government, which is unable to protect its citizens, make sure those citizens cannot defend themselves.

This is a "gun grabber"???

I'm getting the feeling---one I've had for about two weeks---that *NO* assertion by the Miers camp should be taken at face value---they've already amply demonstrated a fundamental disregard for the truth in their claims.

I'm sure you've been called worse. I don't know what the worst would be. And If I had any idea what a "automon" was, I'm sure you'd have made some sense.

hey, maybe you can find a 5 day old story to repost from the NYTimes to support your opinion. Oh, you did that already, nevermind.
