You or I wouldn't be indicted on such trumped up charges. I think DeLay's political prosecution ought to be stopped, yes. I think his mug shot, if able to be legally stopped, ought to be legally stopped.

All of the criminal defendants that I have represented in the twenty plus years that that I have practiced law claim that the charges are trumped up and that the cops/prosecutor is out to get them. They all think that the charges should be dropped and they all claim they are innocent. If Delay is innocent -- and I believe that he is -- then he will get his mug shot and fingerprints back just like every other defendant who is aquitted. But please, until then, treat him the same as the rest of us commoners.

You've both got the right idea but the wrong phrase. Change of venue means to move a case to a different geographic jurisdiction. What you mean is a Motion to Recuse. That consists of asking a judge to remove him/herself from a case for reasons of actual or apparent inability to hear the case fairly.

Based on these facts, it would be reversible error and a violation of judicial ethics for this judge not to get off this case, if such a motion is filed. (Such Motions REALLY leak off the judges, so lawyers file them very seldom. In 40 years, I filed only two such Motions.)
