I'd say the Judge should recuse himself. It's obvious he's got a dog in the hunt.

Dog Gone says: DeGuerin can only file for a change of venue based on certain factors, none of which involve the donations of the judge in this case. It's looking to me like DeLay's only opportunity for justice will occur at the appellate level.
If this case goes to trial, DeGuerin will file for change of venue, with ample grounds, and I never stated it had anything to do with Judge Perkins Dems or Moveon.org donations.
As a general reply to others, on the MoveOn.org donation, Judge Perkins should have never made the donation, imo, BUT we are only talking about $200 people. If push comes to shove all Judge Perkins has to say is he made it for his wife or something and the matter is over. Another example, MoveOn.org could have been pushing an issue that Judge Perkins really believed in, like balancing the Federal budget, and that was the reason for the $200 donation. Let's also remember that a number of Texas Republicans don't like Prez Bush any longer and donated to Kerry and MoveOver.org last year. So all I am saying is that this issue is a slippery slope that no good attorney would mess with. Also, you dont win legal cases pissing off a Judge over $200 bucks, even if Perkins was dead wrong in making the donation.
Further, any good attorney that has reviewed Judge Perkins decisions in the DeLay TRMPAC Associates cases, will tell you Perkins decisions have been proper to-date.
Now I am not dismissing Judge Perkins $200 MoveOn.org donation because we know that the George Seros Mob is behind Earle the Squirrel and these bogus indictments. But there is almost zero traction with this issue for Dick DeGuerin to utilize at this juncture.

This Jerk, excuse me Judge, no make that JERK, probably contributed to moveon.org on 9/11 to send out the signal at how much he is against Republicans and insure he gets the case against Delay.
That's how these politically biased judges, I mean JERKS operate. Texas for a long time was controlled by democrats and they are still deeply rooted in the so-called justice system.

I concur that DeGuerin will file for a change of venue. He'll try to get it moved to Fort Bend County. And it won't have anything to do with these donations.
I have my doubts whether this judge will grant that motion.
The donations are important in the battle of public relations. DeLay does have to seek re-election next year, and any impression that he's being railroaded by a partisan DA and judge will only help him.

This is the judge that married my wife and I. He also married my sister and her husband. Both of our families are as conservative as they get. These weddings were about ten years ago.
Judge Perkins did not appear to us as a reactionary or leftist scumbag or enemy within that some are saying. He appeared to us to be an old-time LBJ Democrat, as are/were most of the old timers in central Texas. I think he ran for Texas Supreme Court at one point, but lost.
Of course, this doesn't mean he doesn't have it out for DeLay - he did donate to Move-On. But hopefully it'll add some perspective.

Actually, it looks like they do have grounds for change of venue, as the Election code states that the jurisdiction for election code violations is the candidates home district. here's part of Dick DeGuerin's filing to have it quashed:

AHA! Now it becomes clear as to "why" Earle thought he could get away this blunder bust. The ACLU uses the same tactics.
To: rocklobster11
Do they have an Election Code in New York and, if so, why aren't they prosecuting Hillary Clinton on similar charges?
To: BigSkyFreeper
"he's a Clinton appointee."
Isn't he a state judge? If so, he probably was appointed by Ann Richards or an earlier Democrat governor.
