Petition for the Withdrawal of the Nomination of Harriet Miers to the U.S. Supreme Court

WE ARE REPUBLICANS AND CONSERVATIVES who supported the election of George W. Bush in 2000 and 2004. Today, we respectfully urge that the nomination of Harriet Miers to the United States Supreme Court be withdrawn.

The next justice of the Supreme Court should be a person of clear, consistent, and unashamed conservative judicial philosophy.

The next justice should be a person of unquestioned personal and political independence.

The next justice should be someone who has demonstrated a deep engagement in the constitutional issues that regularly come before the Supreme Court — and an appreciation of the originalist perspective on those issues.

The next justice should be a person of the highest standard of intellectual and legal excellence.

For all Harriet Miers. many fine qualities and genuine achievements, we the undersigned believe that she is not that person. An attempt to push her nomination through the Senate will only split the Republican party, damage the Bush presidency, and cast doubts upon the Court itself.

Sometimes Americans elect Republican presidents, sometimes we elect Democratic presidents. Whatever the differences between the parties, surely we can at least agree on this: Each party owes America its best. There is a wide range of truly outstanding legal talents who share the president’s judicial philosophy. We believe that on second thought President Bush can do better — for conservatism, for the Supreme Court, for America.

Two things stand out

1. The dems were on the ropes having looked like horses asses in the Roberts hearings that is why Reid and Schumer had nice things to say about Meirs . They DIDN'T WANT A FIGHT and Bush left them off the ropes instead of pressing the attack

2. Bush/Rove are out of touch with their base as they NEVER expected this back lash ( the unhappiness over the out of sight spending and immigration should have been a clue that the natives were very restless but wasn't )

Ummm - a few weeks ago -weren't we conservatives arguing that the pick is the President's and that the Senate et al should butt out?

Bush will be Bush, not Ronald Reagan. Even Reagan picked some justices that turned out not as expected. If we wanted a strong conservative in there, we should have picked Ralph Reed rather than Bush as our candidate.

I believe in President Bush, he has the media and the dems after him over everything he does.clinton was the worst president during my life time. No matter what he did his numbers were up because of the media.

He has named this woman. He knows her and thinks she will do well so of course everyone has to bring her down. I will stand by her.

Ann Coulter has lost one fan! I will never buy another of her books and will toss out any in our home.

No, I don't know it. The unappeasables have made their point loud and clear, and the senators will have to ask tough constitutional questions (which their staffs will have prepared since none of them know squat about the constitution).

I'll be curious how she answers them. You won't because your mind is already made up, I guess based on some columns from people who earn their living by writing interesting or controversial columns.

You must not have been around during Vietnam or during the Civil Rights era, or your memory has grown conveniently dim. I am asking how far some people would be willing to go if they don't want to wait for the legitimate Constitutional mechanism to work. It's a fair question.

The irony of a "Republican" knocking those who strongly disapprove of Miers' nomination is apparent in the train of thought which, at its core, is not terribly dissimilar to those who supported McCain-Feingold CFR. In each case, free speech is attacked.

Then there are the Senate staffers leaking to the press & crying in meetings, personal attacks on the nominee, and even the distortion of Laura Bush's comments. All that's left is a parade in Washington chanting "Hey Hey Ho Ho Harriet Miers has to go" and singing of "We Shall Overcome".

I respect your views, and grant that you have a point. But I'm not very hopeful that the Senate review will be anything but a circus. We SHOULD have some chance to find out where she stands on the issues, since we know so little now, but I'm not sure that we'll get that chance.

So, where will that leave us? Right where we are now, but with Miers possibly confirmed.

And if Miers is withdrawn, where will that leave us? Is there any reason to believe that if Miers is withdrawn the seat will be given to someone better?
