Petition for the Withdrawal of the Nomination of Harriet Miers to the U.S. Supreme Court
NRO ^ | 10/12/05 | David Frum

Posted on 10/12/2005 5:26:46 PM PDT by StatenIsland

WE ARE REPUBLICANS AND CONSERVATIVES who supported the election of George W. Bush in 2000 and 2004. Today, we respectfully urge that the nomination of Harriet Miers to the United States Supreme Court be withdrawn.

The next justice of the Supreme Court should be a person of clear, consistent, and unashamed conservative judicial philosophy.

The next justice should be a person of unquestioned personal and political independence.

The next justice should be someone who has demonstrated a deep engagement in the constitutional issues that regularly come before the Supreme Court — and an appreciation of the originalist perspective on those issues.

The next justice should be a person of the highest standard of intellectual and legal excellence.

For all Harriet Miers. many fine qualities and genuine achievements, we the undersigned believe that she is not that person. An attempt to push her nomination through the Senate will only split the Republican party, damage the Bush presidency, and cast doubts upon the Court itself.

Sometimes Americans elect Republican presidents, sometimes we elect Democratic presidents. Whatever the differences between the parties, surely we can at least agree on this: Each party owes America its best. There is a wide range of truly outstanding legal talents who share the president’s judicial philosophy. We believe that on second thought President Bush can do better — for conservatism, for the Supreme Court, for America.

You can identify the anointed ones by their conservative speech and socialist actions.

According to the Constitution, you are also qualified to be on the Supreme Court. As a matter of fact, so am I.

You are absolutely unreal. You actually fear a slippery slope between writing petitions and assassinations?

Just when I thought I've seen it all on FR.

"Nobody seems to want to wait for the hearings, which kind of makes me question why we even have them."

Having watched the last several, I have the same question.

Naw ~ sure, there are a handful of religious bigots trying to fire up the Religious Wars again, but they're mostly over at NR or NRO, and can be safely ignored.

This Frum guy, though, is a real sicko.

The hearings will be a sham and you know it. The GOP senators are too lame to confirm a proven conservative, they're too lame to toss Harriet. Now is the time.

Ummm - a few weeks ago -weren't we conservatives arguing that the pick is the President's and that the Senate et al should butt out?

My thoughts exactly. If you believe in a principal, there's no time like the present to fight for it.

On another note, I am so sick of the term 'elitism' being dropped every time someone says they are against the Miers nomination. That is a cop-out, very similar to the way Democrats try to shut down their opponents on debate shows. I am not an intellectual elitist, but I'm disappointed in her nomination. From what I've seen, heard, and read, she just doesn't cut it for me.

"This is where too much compromise leads. If you make power trump principle, pretty soon you have a crisis like this one."

Bingo. This is a clash of the pragmatics and the conservatives for the soul of the republican party

Conservatives have compromised on big government, and spending, ceding power to the Pragmatics.

The Pragmatics won on this nomination, despite GWB's assertion that he would nominate conservative justices - principles were compromised in favor of a perceived "confirmability factor".

This clash between two wings of the Republican party was inevitable. If conservatives lose, there is no end to compromising on principle - which is to say, there are no principles.

Conservatives had to draw the line. This is it.

You all have said that the process won't work, that the Senate won't do its job under the Constitution. Why should we rely on them to do what they're supposed to do.

After all, this is a republic. They are accountable to the people.
