Miers Remorse: Conservatives are right to be skeptical

I have changed my mind about Harriet Miers. Last Thursday, I wrote in OpinionJournal's Political Diary that "while skepticism of Ms. Miers is justified, the time is fast approaching when such expressions should be muted until the Senate hearings begin. At that point, Ms. Miers will finally be able to speak for herself."

But that was before I interviewed more than a dozen of her friends and colleagues along with political players in Texas. I came away convinced that questions about Ms. Miers should be raised now--and loudly--because she has spent her entire life avoiding giving a clear picture of herself. "She is unrevealing to the point that it's an obsession," says one of her close colleagues at her law firm.

No. But it seems that nobody is entitled to "a right to privacy" anymore. I guess who you go to bed with, what your favorite position is, whether you like your toes sucked on or not, is all very important information which everyone needs to know if you are going to sit on the bench of the highest courts in the land. Doing your job and having that part of your life on display just isn't good enough.

That's incoherent. By that logic, I would have to have supported Clinton, because he was favored to win in '92 and '96. I supported President Bush - and still support him - because of standard republicans principles, and because the promises he made with in accordence with those principles. One of those promises was to elect judges in the mold of Thomas and Scalia. But Meirs is the anti-Thomas or anti-Scalia. A cipher, a social climber, a woman of no intellectual distinction.

(BTW, a little logic would help, Howlin. If I supported President Bush because he was going to win, then why would I care if he was not "towing" my line? I supporting the President because his promises as a candidate in 2000 and 2004 did tow my line. But picking a cipher like Miers broke one of those promises.)

Your passion comes from loyalty to President Bush. But that should not be a primary priority. It's principles that control human affairs, and long after President Bush's presidency is over, a Miers on the Suprme Court would continue to damage the country. If appointed, she'll likely be on the court for at least another 20 years.

LOLOLOL......she sticks to the facts of the cases and sticks to the law instead of personal 'feelings'.

Can't have someone like that!

Imagine if all attorneys practiced law according to their own personl desires rather than the facts!

There seems to be a shocking amount of ignorance among the elites.

Last Sentence in the Article. Ouch!

With such high stakes, it should disappoint everyone that the Senate will now have to debate the confirmation of a nominee who, when it comes to Constitutional law, resembles a secret agent more than a scholar.

And once we lose the abortion battle in the Senate (as we surely will, because we do not have 50 pro-life senators), then what? We take our rigidly pro-life viewpoint to the voters? Where we don't have a 50% majority either?

But we will be ideologically pure. I'm not mocking the idea, which is shared by many. I am arguing against it because I see it as a losing strategy.

Miers has been a lawyer for 30 years. Head of the Texas state bar association. Managing partner of a large Texas law firm. Legal council to the POTUS. Miers may not be another Scalia, Thomas or Luttig, but she is qualified to sit on the high court and has expressed publically that she will interpret the Constitution with the original intent of the Founding Fathers in mind. And Miers will be more conservative then the justice she'll be replacing, SD O'Conner. Unless something comes out of the Senate inquisition or shortly hereafter, Miers will be approved.

John Fund's point is that conservatives have been burned by assurances before. Its not easy to determine what Miers' views are from the absence of a paper trail. So this is a situation where we are asked to take the nominee on faith. And that's where a lot of conservatives have doubts.
