ROBERT BORK CALLS THE HARRIET MIERS NOMINATION "A DISASTER" ON TONIGHT'S "THE SITUATION WITH TUCKER CARLSON"

SECAUCUS, NJ - October 7, 2005 - Tonight on MSNBC's "The Situation with Tucker Carlson," former judge and Supreme Court nominee Robert Bork tells Tucker Carlson the Harriet Miers' nomination is "a disaster on every level," that Miers has "no experience with constitutional law whatever" and that the nomination is a "slap in the face" to conservatives.

Following is a transcript of the conversation, which will telecast tonight at 11 p.m. (ET). A full transcript of the show will be available later tonight at www.tv.msnbc.com. "The Situation with Tucker Carlson" telecasts Monday through Friday at 11 p.m. (ET).

Exactly what part of this statement "A VAST majority of Freepers either agree with Miers selection, or are waiting for more information. I think predicting a "fractured" conservative base is wishful thinking on the parts of the Donner Wing of the Conservative Party." is inaccurate?

OK, but they might be self-explanatory in a different way to someone else, who is equally intelligent and informed.
One thing lawyers and judges do is to try and arrive at some kind of agreement about this. It's a very, very complicated task. I still think you should read some great opinions--it certainly wont' hurt you.

She was selected twice in a row as one of this nation's top 100 most influential lawyers by the premier law journal of this nation. Does that not distinguish her in some way from the hundreds of thousands of working lawyers who weren't selected?

Before I can evaluate that I would have to know how the term "influential lawyer" is seen by the premier law journal.

Santorum will lose big time. I live in a very REPUBLICAN county and the people will not forget Santorum doing Bushes bidding. Result the pubs will lose one Senate seat in PA.

People here do not consider Specter as a republican.

"Influential lawyer" means what it says. Some people are influential because of their work, some because of their reaives. I believe Miers got onto the list because of her work and position, while Hillary got onto it because of her marriage and Arkansas connections.

Miers is confirmable.

So are the others. Do the math.

This lame defense of Bush's nomination of Miers, that he turned yellow and ran scared from the RINOs, simply doesn't hold water. Of those few Senators who might have voted against a strong, qualified conservative nominee, I bet they all voted in the past to confirm Luttig, Brown, and Owen to Appeals Courts.

And the entire anti-Miers spin- and there's no use in denying the obvious- boils down to pedigree, time spent in some sort of "constitutional law" apprenticeship, and a discernable "judicial philosophy."

Critics of Miers, some prominent have listed as a disqualification that she went to SMU. That's elitism.

BS. No one has argued that that fact alone disqualifies her. NO ONE.

I can't see that going to SMU law school instead of Harvard law should be part of any disqualification to sit on the SC. At the time of the convention, 13 of the framers were business men, 6 were land speculators, 11 were securities speculators, 12 operated plantations and a few others were small farmers.

These are the guys who wrote the Constitution. One doesn't need to go to Harvard law to understand the Constitution. It isn't a demerit that one goes to SMU Law. It's elitism to think that it is.

How many "elite law schools" were there in the 13 colonies? Go ahead---tell us.

Oh yes, she will get her hearing, and she'll get onto the court. And she'll probably give reasonable conservative votes (probably...)(and probably Rogers will too...probably...)
But humpty-dumpty still won't be able to be put back together again.

Sorry, Lancey. Without overcoming the filibuster, none of them are confirmable. And it reasonable to assume that the filibuster will hold, McCain will not break the filibuster.

Brown and Owen are out, as Specter will not even bring them to the judiciary committee. He has said as much about the previously-filibustered candidates.
