Brownback Skeptical on Miers Nomination

Senator Sam Brownback says he and other conservatives have ``a great deal of skepticism'' about Harriet Miers, President Bush's latest nominee for the Supreme Court.

The Kansas Republican is disappointed Bush did not pick a candidate with more of a track record. He had urged Bush to nominate someone who opposes the Roe vs. Wade decision legalizing abortion.

Brownback compared the nomination of Miers -- Bush's White House counsel -- to that of Supreme Court Justice David Souter. Souter was nominated to the high court by the first President Bush and was believed to be a conservative, but he later turned out to be liberal on the bench.

Brownback is a member of the Senate Judiciary Committee. He will meet with Miers in his Senate office on Thursday.

Txsleuth,

If it's any encouragement. We survived Terri Schiavo. That was far more contentious. We'll survive this disagreement. If we can't, we're weaker than I believe us to be.

For the record, though, Pat is the last one to speak of betrayal. He's been advocating impeachment of the President. He has no credibility with the majority of conservatives no matter what position he takes on Miers.

Thomas, if you are old enough to recall, was also characterized as "mediocre, unknown, and a big gamble" when Bush I nominated him.

Does anyone actually believe that he would have chosen this person if confronted with the prospect of Senate Judiciary Committee Chairman Kyl, instead of Arlen "Not Proven" Specter?

I dunno. Maybe that's why he campaigned for Specter, not Toomey (the conservative.)

Boy...Trent Lott...isn't that a name we haven't heard from in ages...and not just because of the Hurricane.

He has dropped off the political scope. He was a weak kneed leader if there ever was one.

What is it with these Senate Leaders who won't PUT THE HAMMER DOWN, DAMN THE TORPEDOES...FULL SPEED AHEAD!

For crying out loud...LEAD WITH PASSION AND CONVICTION!!!!!! ACT LIKE YOU KNOW WHERE YOU ARE GOING!!!

Oops. There is the problem. Our current Senate leadership don't have an aim and goal of where they want to go. You can't put the hammer down without clearly articulated direction and aim.

Very good analysis. I would also add that even if both Roberts and Miers turn out conservative in Scalia's mold, -- not bloody likely, -- considerable damage has already been done to the conservative movement. That is because the pattern has been established that conservatism is, like some shameful disease, something that needs to be hidden and outweighed by a lifetime of liberal outreach and demonstrations of impartiality and balance. So Roberts volunteers for the homosexual agenda work, and Miers pleads with the ABA to carve a modest minority niche for pro-life lawyers, while playing coy with Roe v. Wade questions.

We would have been farther ahead with two more failed Bork nominations than with these two shrinking violets.

C'mon...the American people both left and right deserve a candidate that it is a known quantity.

There is something very unsettling and smelly about how he arrived at this decision.

Definitely. Just a little too compassionate for me. A 'politically correct' nomination, even. Stealth, shmealth.

I don't know who you think you are talking to, but I've been on the RIGHT side since before Goldwater. You've been reading too much history and not remembering it (or didn't experience it).

A vast majority of conservatives supported Thomas even BEFORE his stellar response to the lying Anita Hill. Get your facts straight - and from more than an article on NRO and then come back and talk.

No I do not....in fact, if Kyl were the Chairman, I suspect that he would have been right by Bush's side when he announced Luttig or Janice Rogers Brown....

I will say this though...I guess Miers has the hide of a rhinocerous, because she is being labelled as just so much "lawyer trash" by even the CONSERVATIVES...let alone the crap that the liberals always say about Bush's picks....that if it were me, I would call ole Dubya up and say, FORGET IT....

We need new Senate Leadership NOW. Maybe Frist should give it up and call a new Senate Leadership election.

Forget all the stuff about who has been here the longest (Seniority). It never works anywhere I am familiar with, except in war...and even then it is not 100%.

Frist? the Others in Senate Leadership? Like in Parliament...call for a NO CONFIDENCE VOTE! The Dems would love to join our conservatives to pull that off. Then vote in TRUE CONSERVATIVES to run the Senate.

You have to have a thick skin to make it onto the Supreme Court.

And sometimes even that doesn't help much.

Just ask Associate Justice Robert Bork.

Anyone with any sort of outstanding scholarly credentials whatsoever will never be nominated in the future. Unless of course that person is a radical Democrat, in which case he or she will be swiftly confirmed, a la RBG. Roberts has "outstanding scholary credentials" and he was swiftly confirmed. He was vetted by a team lead by none Miers.

I object to a stealth candidate on principle. There's nothing wrong with being a conservative. We can win in the arena of ideas. Let the Left hide who they are and their beliefs. This is where the President missed an opportunity. Conservatism is the mainstream not liberalism and I get sick and tired of us acting like we're the weird fringe and not them.

I'm starting think that just maybe Bush is a lot more like his father than we had been led to believe, that is - not as conservative as advertised. Add to that the fact that he appears to have put his faith in front of his common sense with this nomination and, as a consequence,conservatism has taken a back seat. It is, methinks, the lady's religion that scores the most points with Bush and neither her political philosophy (really known only to Bush), her experience (lacking) or her conservative credentials (does she have any?) count as much. This seems like a terrible risk to take when there are highly qualified people waiting in the wings who have well established and demonstrably long term commitments to sound judicial principles and the proper application of the law and the constitution.

George Bush has made a tragic mistake and has lost a huge share of his base forever. Count me among that group.

Roberts was the perfect candidate: stellar credentials and clean paper trail. Unfortunately a female Roberts did not exist.

Rogers Brown was a bomb thrower who absolutely would have been filibustered and allowed the Dems to peel off a few RINOS. She screwed herself by being so over-the-top.

Mahoney, who I have heard many conservatives wish for, is pro affirmative action.

The much talked about Ediths are actually relative lightweights, just like Miers.

The male dream candidates Luttig and especially McConnell would have been better, but unfortunately the desire to nominate a woman held sway over even strongly conservative women and that affected the outcome.

We also don't know if some of wished-for nominees turned down the job. Not everybody wants to go through the grinder.
