So far, The Big Buy has received almost no attention in the press. With DeLay's indictment, and increased attention to Earle as well, that situation seems likely to change. (The filmmakers say they will be back at work next week, filming a new ending to the picture.) "We're pretty low on everybody's radar," Schermbeck says. "We kind of took a gamble three years ago. We didn't know what was going to happen. We feel like, as documentary filmmakers, we gambled and it paid off."

It sounds to me like prosecutoral misconduct to allow FILMAKERS to make a MOVIE about someone being INDICTED!

This sounds like a grand jury POed about gas prices and is starting early on getting rid of the GOP. Since the charges don't make sense it sounds as good as any reason.

Actually, he can. He can sue for malicious prosecution, though in Texas state courts it is tough due to restrictions on suing governmental entities. The best way to do it is to allege civil rights violations and sue under those, with added causes of action, in either Federal or state court. Federal is usually the best bet as they are more familiar with the issues involved.

A prosecutor is duty bound to exercise his best judgment both in deciding which suits to bring and in conducting them in court. The public trust of the prosecutor's office would suffer if he were constrained in making every decision by the consequences in terms of his own potential liability in a suit for damages...We agree with the Court of Appeals that respondent's activities were intimately associated with the judicial phase of the criminal process, and thus were functions to which the reasons for absolute immunity apply with full force."

That's quite a stretch even for Ronnie Earle

I heard a bit on Fox last night -- I think it was a Dem quoted as saying Earle sics his people on targets because he thinks what they're doing is wrong, even if it's not illegal and no one can figure out what they could claim is illegal. Isn't that Spitzer's MO too? (Seems that there should be some recourse against these people, but what do I know?)

I agree with you completely, Earle's jusy trying to cover his butt. Delay's indictments will be tossed out and Earle will be exposed for the political hack he is.
