I've actually thought this may be one of the reasons...especially since he originally wasn't going to indict Delay. He changed his mind for some reason.

I appologize for my short sightedness. After seeing the Miers nomination, and she and/or Roberts prove to be another Souter, this DeLay Indictment was to force a SCOTUS deal and not simply to save a Louisiana Democrat.
