I think it's called malicious prosecution and they can do that.

And .. he's already brought a false prosecution against Kay Bailey Hutchinson. The judge threw it out.

Ronnie Earl's case against DeLay, reminds
me an awful lot of the recent case by the
California prosecuters case against
Micheal Jackson, only a lot weaker.

I'm not saying Micheal Jackson was
innocent, but that it became quite
clear long before the case was given
to the hury, that the cornerstone of the
Prosecuters case, was based on victim & witness testimony..of a family of known grifters...
and would be thrown out for the fact that
the DA could not prove beyond a resonable
doubt...

a conclusion i publicly stated long before
the "mother" ever testified.

I'll bet the same thing happens here, and
it could jst end up blowing back on Earl, for
malfeasance.

Someone beat that girl with an ugly stick.

Nope...lit her face on fire and tried to beat the flames out with a track shoe.

No... but he CAN be prosecuted for malfeasance in office. Using your office for political gamesmanship would qualify.

After doing some looking around myself, I found this post from RatherBiased.com about the same fundraiser :

Barnes, Rather Daughter Co-sponsored Fund-raiser.

Written by RatherBiased.com

September 12, 2004 | 10:22:08 EDT

Ben Barnes, the Democratic lobbyist and former lieutenant governor of Texas who was featured prominently in the 60 Minutes report that triggered the Memogate controversy, was the co-sponsor of a fund-raiser for a liberal district attorney in Texas along with Dan Rather's daughter Robin. According to the web site of Ronnie Earle, district attorney for Travis County, Texas, Ben Barnes and Robin Rather were among a the small group of sponsors for an October 3, 2000 fund-raising event for Earle's reelection campaign.

In 2001, Dan Rather was the keynote speaker at a Travis County Democratic Party event. He spoke there at the behest of his daughter.
