Washington Post ^ | Sept. 28, 2005 | Dan Balz and Amy Goldstein

Posted on 09/28/2005 5:55:58 AM PDT by katieanna

The upcoming battle over a successor to Supreme Court Justice Sandra Day O'Connor threatens to plunge the Senate into another bitter confrontation over filibusters and the "nuclear option," with Democrats already threatening to use any means possible to thwart President Bush if he nominates someone they regard as too conservative.

teh Dems better watch the precedents they're setting - someday one of their guys will be doing the nominating, and the republicans will be doing the obstructing.

what goes around comes around.

If they are going to fillibuster, go ahead and go for the golden ring.

Nominate Luttig.

As an aside, I read a name yesterday mentioned for the Supreme Cuurt that I had never heard before.

He is Justice Raoul G. Cantero of the Florida Supreme Court. He is only 45, Hispanic, conservative and in tight with Jeb Bush (who appointed him to the Florida Court).

I found a web site or two about him and he doesn't sound bad.

these threats are just stupid. Why are they getting their panties twisted when they don't even know who the nominee is?

Indeed. Putting the cart before the horse, as democrats are wont to do.

Republicans will not resist - they will bluster and then cave. Republicans are the frog in the frog and the scorpion tale.

The democrats will not allow that to happen. When they next take control of the Senate, the first order of business will be to force through the rule change which will disallow the use of judicial filibuster.

from a dem perspective a committee of ten democrats (that votes 6-4) is bipartisan, a committee of five dems and five republicans (that votes 10-0) is a right wing extremist group.

The Democrats are openly against the next nominee, regardless of who it might be. I hope the American public is paying attention to this liberal circus. Legal qualifications are no longer important to the Democrats. Only ideology matters.

As we all know, the Democrats want the courts to be an active extension of the minority legislative party. Their view is "Damn the voters, full speed ahead!"

It is time for the Republicans to take their last golden opportunity to show they have backbone and for President Bush to leave a legacy that will dam the flow of Leftism that is destroying our country: nominate Janice Rogers Brown.

I sincerely hope they filibuster a qualified and inarguably conservative but extremely fair judge.

Most Americans wouldn't mind seeing Roe v. Wade reversed and the issue of abortion referred back to the state legislatures. The fear mongering left has a lot of people believing that if Roe v. Wade is reversed that abortions will become instantly illegal.

The reality of the situation is that legislatures are most likely to limit and restrict abortions in a manner consistent with the wishes of those they govern. This means the majority will agree that unlimited abortions on demand are wrong and that laws should be enacted to reduce the demand for abortions, not satisfy every whim.

But even then, I have my doubts that a slight shift to the right on the courts will seriously affect Roe v. Wade unless a legal argument challenging the so-called right to privacy can be made and won on a non-abortion related case.

The Democrats are about to demonstrate their highly partisan, obstructionist intentions when, on Thursday, between 17 and 28 of them vote against Roberts. OF COURSE their going to fight WHOEVER Bush puts forward. Good. Let them. Then, use the Nuke option and get it over with.

I know that there are good judicial names floating, but I will be unhappy with anyone but Janice Rodgers Brown. For one reason, because I read the WH was too worried about her straighforwardness. I WANT that and want to see her nominated. And I am so tired of everyone calling the president a racist in the wake of Katrina. I want the Dems to publicly play their racist hand instead for all to see. JANICE RODGERS BROWN!!

what goes around comes around.

I hope not on both counts
#1 I hope we don't see a Liberal democrat back in power
#2 I hope the republicans aren't stupid enough to try to play these games...The MSM would never allow any Republican to get away with the games & obstruction the Democrats get away with.

Isn't Janice Brown the Black Conservative?
They treated her horribly before..I'd love America to watch white DEMOCRATS go after a Black Female Conservative.
Lets hope Bush doesn't break our hearts (again)

I have more confidence predicting that the Dems will fillibuster than I do predicting that the GOP will nuke them.
