Major Victory For Firearms Owners And Freedom In Louisiana

(Fairfax, VA) -- The United States District Court for the Eastern District in Louisiana today sided with the National Rifle Association (NRA) and issued a restraining order to bar further gun confiscations from peaceable and law-abiding victims of Hurricane Katrina in New Orleans.

“This is a significant victory for freedom and for the victims of Hurricane Katrina.  The court’s ruling is instant relief for the victims who now have an effective means of defending themselves from the robbers and rapists that seek to further exploit the remnants of their shattered lives,” said NRA Executive Vice President Wayne LaPierre.

Joining LaPierre in hailing the U.S. District Court decision was NRA chief lobbyist Chris W. Cox. “This is an important victory.  But the battle is not over.  The NRA will remedy state emergency statutes in all 50 states, if needed, to ensure that this injustice does not happen again."

The controversy erupted when The New York Times reported, the New Orleans superintendent of police directed that no civilians in New Orleans will be allowed to have guns and that “only law enforcement are allowed to have weapons.”  ABC News quoted New Orleans’ deputy police chief, saying, “No one will be able to be armed. We are going to take all the weapons.”

The NRA also pledged that it will continue its work to ensure that every single firearm arbitrarily and unlawfully seized under this directive is returned to the rightful law-abiding owner.

The problem is, from what I believe, that the police officers refused to give them receipts. The news story mentioned that. They were just taking the guns. No receipt, no nothing.

Probably all the welfare queen gun owners who don't belong to any gun rights group and leave it to the rest of us to carry their dead asses.

I say confront every welfare queen gun owner who sucks off the cash and support of all the responsible gun owners who protect their rights. There are a bunch on FR. They slam the NRA and son't do anything but squeal about how the NRA isn't any good. Welfare Queens - all of them.

What was the wording of the court order? Did it provide any recognition to "individual rights"?

I haven't seen it, so I'm shooting from the hip here. I'd be extremely surprised if the court invoked the Second Amendment. I'd say the best we could expect is that the court cited LA RKBA statute violations.

It's also possible the court didn't say the confiscation itself was illegal, just the way the order was implemented.

Did it provide any recognition to "individual rights"?

IIRC, stare decesis(sp?) compels this court to follow the dicta of the 5th Circuit in the Emerson decision that the RKBA is an individual right, but I'm no lawyer.

Let's hope it's not overturned on an appeal.

I don't think Compass, Nagin or the New Orleans DA's office would *dare* to appeal this--

I'll see if the full text is available online yet, although I don't have access to LexisNexis or the pay-per-page service the Federal Courts have set up.

GREAT !!! Thanks to the NRA. I was amazed that a police chief would issue such an order. Obviously he was educated in a 'publik skool' and had no idea what a 2nd amendment was nor was he cognizant one even existed.

Sorry, my bad. I was trying for some humor and it missed. "Write your own receipt on the back of a $50 bill and turn it in to the NOPD" would be about right, don't you think?
