Actually, I'm talking about the votes that matter. That is, the ones from the Senate Judiciary Committee. The 96 votes Scalia got were after the committee vote, and the reason they were so high is because the Senate unites to support the committee recomendation. Somewhat of a tradition.
I suspect it's going to be. This next confirmation is going to be the most bruising since Clarence Thomas, and the people in the White House probably feel it'll be a little more difficult for the Dems to beat on a woman than a man. There'd be more public sympathy for a woman getting cruelly mauled than otherwise, and the Dems know that.
No Consuelo Callahan is a woman, former state court judge now sitting on a 9th Circuit.
