9th Circuit Court of Appeals... the most overturned court in American judicial history.
Remembering that Roe v. Wade basically violated the doctrine of stare decisis. It cited no relevant precedent prior to 1960.

LOL. What an inopportune time. The Democrats just can't win. This will put momentum for an even more conservative nominee to replace O'Connor.
Everyone has considered this constiutional since Eisenhower's day. But now, suddenly, one justice objects. Yet,
in Roberts hearings,
"Thirty-four times this morning, the senators and the nominee mentioned stare decisis -- the Latin term for letting existing precedents stand."
So when it comes to Roe vs. Wade, 'stare decisis' must be the deciding principle. When it comes to the Ten Commandments being displayed, or prayer in schools ( a practice of some 300 years' standing), or the pledge,
the existing precedence means nothing.
