CALERA (OK) - After losing everything to Hurricane Katrina, a Louisiana woman waits with her family in a hotel room in Dallas for her son to bring money to keep the room another night. Her 23-year-old son will not get there in time, because on his way through Calera, Monday night, he ended up in jail.
About 2 a.m. Monday, Calera Police Officer Kurtis Smith attempted to pull over a car for traveling 76 mph in a 55 mph speed zone. The report states Smith turned on his lights and siren, but the car continued to travel 70 to 75 mph and refused to stop.
Smith's report states he saw two people in the car and the passenger became "very active" by leaning over in the seat. The car then stopped.
Bryan County Deputy Javier Guerrero arrived for assistance. The report states that both officers noticed the smell of marijuana coming from the car. When Smith asked the driver why he didn't stop, the driver said he was listening to the radio and didn't notice the police car behind him.
The report states that Smith told the driver he could smell marijuana and the driver said he was smoking it earlier, but he didn't have anymore with him. The report states that smith searched the driver and found a stack of money in his pocket.
According to the report, the driver told Smith he was from Louisiana, and was coming from his girlfriend's house in Tulsa. He was on his way to Dallas where his family was staying in a hotel, because they lost everything they had during the hurricane. He told Smith his family was about to lose the hotel room because they had no money. He told the officer he was taking the money to them in Dallas.
According to Smith's report, police found a green leafy substance on the female passenger's pants and on the floor of the car. They also found a tin container with green leafy substance that field tested positive for marijuana, rolling papers, a glass bowl with residue, tweezers. Also found was a black bag, on the back seat, containing two bundles of money. Each bundle contained $1,000.
Smith found a 9 mm handgun in a black bag, the magazine loaded but not in the gun, the report states. He also found a .22 caliber pistol, the magazine was loaded and inserted in the gun. The report states that Smith was alerted, by radio, that the driver had a prior felony conviction.
Smith's report states that prior to taking both driver and passenger to Bryan County Jail, the driver's cell phone rang. The driver asked Smith to answer it. The call was from the driver's mother. The driver asked Smith to talk to her. Smith's report states the woman verified the driver's story of them being in distress and needing money for the hotel room.
According to the report, the driver was transported to Bryan County Jail and booked on charges of possession of a firearm after a felony conviction, possession of marijuana and speeding.
The passenger was booked for possession of marijuana. The money inside the black bag was counted, totaling $2,456.
Don't do the crime if you can't do the time.

I love the way this article starts out. It sounds like the heartless LEO jailed the guy for speeding. Reading through, the story drips out the details; marijuana, a gun, two bags of cash. what was the officer going to do; issue a warning?

If he is a convicted felon he could be locked up for just the two guns.I have to question the intelligence of a convicted felon who carries two guns in a car while he speeds down the highway smoking a joint.He should have painted the words "Arrest Me" on the sides of the car.
Personally, I don't think the possesion of a small amount of marijuana should be illegal, but that would probably be a misdemeanor in any case. The fact that he is a convicted felon with a gun is probably the reason the guy is still in jail.

None the less it is illegal, he's getting what he deserves. If he had driven at the speed limit it is extremely unlikely he'd have gotten pulled over.
obviously the kid really cared so much he broke several laws attempting to get there. are we supposed to grieve over this or what?
That actually might have been a better business plan. There are probably a lot of folks in Houston and Dallas who have had their supplies disrupted and who would perfer to deal with a guy from home instead of the local folks.
I don't have a problem with the cops pulling them over, or taking them to jail. I don't even have a problem with them holding him on the gun charge, although without the gun charge he probably would have been out already. I do have a huge problem with cops being able to seize money or vechicles.
