OK. Here's the "Fourth Amended Complaint" in the state court, which is in Jim Hogg County Texas:

http://www.splcenter.org/pdf/dynamic/legal/leiva_v_ranch_4th_am_pet.pdf

You are right that Jacobson is listed as Nethercott's lawyer.

Puzzles: 1. You usually don't do even one, let alone 4 amended complaints unless the defendant has answered, or at least appeared.

2. If Jacobson was representing him. at least thus far, what kind of "default" was it that all the news accounts say occurred?

3. Does Nethercot have a malpractice suit against his attorney?

4. What does the Jim Hogg COunty court judgment look like?

I have to wonder where some of these "tough on immigration" people were before Bush was President.

Can't answer for everybody, but for myself, I was stumping for him and encouraging people to vote for him so he might get elected as our President. Obviously, the cumulative effect builds up over time, but it's amazing how these problems only seem to crop up when a Republican occupies the White House.

The first part of that is right. The problem has built up over time. How far back do we have to go to see where the courts began granting government benefits to illegals? I believe that the strong economy, especially the housing boom which is attracting so many illegals because of the jobs it has created, has brought it to the attention of those north of the border states.

Also, the public is better informed now then it was even ten years ago because of the Internet. Additionally, there is the not so insignificant fact of 9/11, and what dangers open borders might entail in a time of war which has probably not been something anybody had to think about much since WWII. There are many things at play, but to characterize people who are in favor of securing the borders by suggesting that it is only because Bush is President and happens to be a Republican just isn't accurate in the least as to why this has become a rather big issue. That argument is just as hollow as calling folks who want the border secured racists. There is just no basis in fact to support it, though lord knows there are those trying to do that.

You want the borders open? Just say so. But stop your baseless attacks.

Yeah, and why anyone has not arrested them and deported them because they are ILLEGALLY IN THE COUNTRY.

Not like a judge, court clerks, sheriffs, lawyers (under oath as representatives of our courts) didn't KNOW they were frickin' illegal aliens.

Did they even get citations? A tiny fine? A reminder that they were here illegally? No?

1. I can't wait until one or the other of these clowns pops an illegal for imposing on "their" ranch, then defends himself in court because he has PTSD.

2. I just heard GWB is in L.A. tonight (wondered what the F-18s were all about); wish I could get a ticket and ask him why prescription drugs are the issue today and not illegal border invaders with their sights set on taking and holding US territory!

A lot of us never assumed this problem would become as huge as it has.

I can remember not too long ago (not at all) that, even in California, there were not so many if any illegal aliens and most when they were noticable were written up in articles in the LATimes, of all places, as being in downtown LA, garment industry (Asian mostly) and then the huge Mexican populations started sprouting in Santa Monica and downtown began to resemble Mexico City and now does.

And the Valley, too...used to be predominantly retired people and young single workers and literally in only ten years transformed into Mexico City Three.

Same with Colorado. First and not very long ago, people started complaining to law enforcement about 'camps' and "trailers filled with illegal aliens" and they got laughed at and ridiculed, as if they were describing aliens landing on the neighbor's ranch (actually, they were but not those from another planet). Point is is that everyone who made a public statement about this problem were ridiculed when they were not reprimanded for not being "humanitarian" and "having sympathy" and such.

I can remember Denver and not too many years ago when there was no large Hispanic population there, if Hispanics at all. And I mean that, it was not that long ago. Same with the entire state, actually.

Most of us thought that the legislation passed under Governor Wilson in CA would end the problem in CA (the majority voted for it), and most of us also thought that this was a problem of CA's and New York City's and maybe New Mexico but no one ever foresaw the millions here now who have arrived illegally in the country in only the last eight/ten years.

I think people are only just being able to speak out and share the frankness of the problem and the very real and difficult realities related to it and caused by it.

And noticing with the helps of the internet that it is not an isolated problem limited to certain contained locales but literally nationwide.

planekT...yep.

GoBucks2002....just because very bad policy came before BushII doesn't mean he can't do something about it now. He is, afterall, the present President. I just think it's a shame that all of our "elected officials", dem or pub, are working for the establishment of the NWO.

You may continue the lockstep support of "W" now.

Puzzles: 1. You usually don't do even one, let alone 4 amended complaints unless the defendant has answered, or at least appeared.

We know the ranch owner, Sutton, was represented by an attorney. He was probably the driving force in getting a quick settlement. Notice how Sutton paid $100k while Foote and Nethercott got nicked for a combined $1.3 million in money judgments.

2. If Jacobson was representing him. at least thus far, what kind of "default" was it that all the news accounts say occurred?

No response. Even if you get served and even if you communicate with the plaintiffs, you still have to file a formal response with the court. Nethercott may have ordered his attorney to do nothing while he deeded the property to his sister. Possibly trying to make himself judgment proof.

3. Does Nethercot have a malpractice suit against his attorney?

Nobody has even hinted at that. I think Nethercott out smarted himself with that phony deed transfer to his sister. I'm equally sure that his attorney advised against that course of action.

4. What does the Jim Hogg COunty court judgment look like?

Good question and I can't believe that Dees didn't post it. Weird.

It would good & wise to vote EVERY Politico in the U.S. Senate (who is up for re-election) and in the U.S. Congress OUT of office in 2006. There is no way that their replacements, however inexperienced or from whatever party could possibly do worse than the current malfeasant incompetents who talk much during media face-time, dress nice and are well-coiffured -- yet, do Nothing. It would do the Nation good to have a 2-year flush and remind those elected just who they work for. The few good guys won't mind and they will get back in." Outstanding. But can enough people be convinced to get off their knees and make it happen? I'm in.

4. What does the Jim Hogg COunty court judgment look like?

Not sure if this is it. Someone will knock it off here pretty quick, I guarantee you. This is very interesting.

Public Notice: Announcing opening for United States Magistrate Judge in Laredo. Applications will be accepted thru September 30, 2005. http://www.txs.uscourts.gov/ Picture here. Not sure if this is it. Wherever it is it isn't very low tech. http://www.txs.uscourts.gov/news/newlaredo.htm

Well, that might be what the court looks like, but not the judgement, which after reading your post again is what you were asking for.

Sorry about that.

Blame it on the Bush administration's continual refusal to protect American sovereignty, which some might think borders on treason.

BTTT

WHY didn't President Bush close the borders after 9/11/01? His negligence has allowed millions of illegal aliens from Mexico and from God knows where else to enter America, and he won't even discuss it with us, he won't even tell us why he has done this to us, and he wants to shove amnesty ("guestworkers") down our throats.

We're not buying it, and we'll let the open borders politicians know it at the polls next year and in '08.
