For Immediate Release: 8/19/2005
St. Louis, MO - In an en banc ruling, the Eighth Circuit Court of Appeals today overturned a lower federal court order requiring the removal of Plattsmouth, Nebraska's Ten Commandments monument. The court had earlier vacated a three judge panel?s decision which upheld the lower court?s order.
The Ten Commandments monument was donated to the City of Plattsmouth in 1965 by the Fraternal Order of Eagles. The Plattsmouth monument is one of many other Ten Commandments monuments given by the Eagles to towns, cities, and states in the 1950s and 1960s.
In its opinion, the court likened the Plattsmouth monument to the Ten Commandments monument at issue in Van Orden v. Perry, where the Supreme Court recently held that the State of Texas did not violate the Establishment Clause when it accepted a Ten Commandments monument from the Eagles. The monument was installed on the grounds of the Texas State Capitol. Brian Fahling, senior trial attorney for the American Family Association Center for Law & Policy, said the court ?found the Plattsmouth monument was a permissible use of the text of the Ten Commandments to acknowledge the role of religion in our Nation's heritage.? In its ruling, the court also observed, ?Although the text of the Ten Commandments has undeniable religious significance, simply having religious content or promoting a message consistent with a religious doctrine does not run afoul of the Establishment Clause.?
The ACLU brought the lawsuit claiming the monument violated the Establishment Clause. The case is ACLU v. Plattsmouth, Nebraska, No. 02-2444.
Thank God.
The ACLU rears it's ugly head, once again.
Once we clean up the Courts, the ACLU will be history.
Thank God! It looks like our citizens are waking up to the fact that the ACLU is trying to destroy all we hold dear and turn this country into a Godless, despotic place.
The ACLU Looses
AGAIN!!!!!
I had to look twice because of the Court Ruling to make certain it wasn't from Scrappleface.com.
One small step for mankind. Another battle won against the
enemy (the transmission belt for Soviet Communist dictatorship -the ACLU ) Many more victories-and the battle is barely joined- the enemy of my country can not be expected to roll over and play dead as our government has too often been willing to do.
Thank God for their rightful decision. It will be interesting to see how many of our local media channels will broadcast this good news .........
I'm glad to see some common sense being exhibited in the courts.. ( of course, it hasn't been appealed to SCOTUS yet )
I see nothing wrong with recognizing and respecting the religious roots contained within our national heritage...
Thank God! Amen.
The ACLU Looses.
Did you mean Loses?
It should cost the ACLU a minimum $500,000 to file any/each lawsuit within the United States of America.
Yep!!!!!!!! The excitement of a Victory over the ACLU was too much and killed the spell checker I guess.
Its time to revoke nonprofit status for the ACLU, and to make sure they get no funding from our government for ANY reason. Don't you think its time?
Yes, but I suspect it takes tax dollars into its' treasury whether or not it wins.
Yep which is why what Tonk (68-69TonkinGulfYachtClub)is pushing and some of our congressmen are pushing must get passed.
