Michael Schiavo Poised To Sue Caregivers

CLEARWATER - Michael Schiavo has asked a court to waive the two-year statute of limitations on filing a medical malpractice lawsuit against one or more of his deceased wife's caregivers.

Terri Schiavo, 41, died March 31 after her feeding tube was removed after a seven-year court battle.

Schiavo's attorney in this case, Mark Perenich, said he was not able to discuss the proposed lawsuit behind Tuesday's request for an extension of the two-year statute of limitations.

By law, medical malpractice lawsuits must be filed within two years of the alleged misconduct unless an extension is granted.

In October 2003, Terri Schiavo's feeding tube was removed on court order. Doctors reinserted it on orders from Gov. Jeb Bush.

Perhaps he's going to sue the original doctors....the ones in the ER. They kept her alive when she was supposed to die.

We'll see. His first burden is establishing his inability to file within 2 years, I can't imagine he could establish that going so far back in time. And I presume they were named in the original suit, you sue everone.

You're right, IMO, if he wants money he should write a book...

I seem to recall reading here that he was shopping a book proposal. Maybe he didn't get any bites.

....Which I'm sure would become a TV movie. He could play himself.

Hmmmm. Well, he's got the ego for it. But he's a bit too surly on camera. How about Mark Whalberg? He already played the role of a sleazy lounge lizard in Boogie Nights. :)

No...it just says "In Re" which is short for the longer title which would have the actual name(s) of the individual(s)/entities being sued, but because of freedom of information, one could go to the Pinellas Court House, however, and get that information from the clerk.....I'm not sure if the "must" supply that information over the telephone.

*He wants money.
*It's also a power thing - why not, since the judicial system has caved to his every demand and none in the power would even save Terri for a barbaric death?
*He wants to hurt others. A lawsuits can be an effective way to harass and harm others and a legal means of extorting money

Another crazy thing is that even though MS sued the docs when Terri collapsed Dr. Prawer was cleared of any wrongdoing by the state yet MS got the $$$$.

He also sued for rehab $$$ yet didn't use the money for rehab, he should have been made to pay that money back.

yep...but marshamallow's article indicated it was to "caregivers".....that could be doctors, nurses, or almost anybody, I would assume, who took care of Terri.

yep to the first; Greer and the rest of the "judges" should not have allowed MS to pay lawyers to kill Terri with Terri's rehab money....but, they can't be sued. Ain't that special?

Yep. I read it. I just can't see that MS has a leg to stand on. Of course, that's not stopped him before. I was wondering if you thought the articles author just assumed it was medical. The article says: By law, medical malpractice lawsuits must be filed within two years of the alleged misconduct unless an extension is granted. Wonder if that applies only to medical. Maybe the writer has more info? I thought you had given a lot. :)

HINO thought having Terri bumped off would make him feel so much better. Apparently, it didn't work out that way. So, he wants more, more, more.

What a pathetic, sad person and he works at the Pinellas County jail. I hope the prisoners spit on him.

Guess he wants to beg off working at the jail by spending the rest of his life in a courtroom blaming everyone for his sorry messed up self.

If he sues Morton Plant Hospital and the doctors who saved her per Jeb Bush's order, then he'll be suing Jeb too unless they made some side deal. MPH gets sued and decides to settle, taxes will go up, malpractice insurance premiums will go up, health care for residents of Pinellas will cost more. WHAT A PIG.

He might be suing them because she had an infection and he ordered them not to give her antibiotics so she'd die of pneumonia. Well, they gave her antibiotics and she improved. Maybe it's pneumonia-gate.

All HINO knows how to do is go to court. He's really bad at going to depositions though. He's a no show at depositions. Do you that HINO got fired from McDonalds????? That's hard to do.

Do you know how tortuous and boring litigation is? Only a sick person would want to constantly in court. Notice, I don't say a court of law because our judges here are crooks. It's not really a court of "law".
