How can this possibly be hard? The law in New Hampshire is clear and we know he is an illegal immigrant.
What a stupid argument - the local police are enforcing local laws, it just happens that the perps are illegal aliens. Since when does being illegal in one area immunize one from laws in another area? The polution argument is a real hoot - the illegal activity isn't happening in another state, it's happening right in the jurisdiction of the police enforcing it. Hopefully the judge has even one iota of a brain cell.

I can hardly wait for this case to be decided. I've been watching and waiting. Either way it's decided, it will set a precedent for all cases after it. I don't envy the judge, if he does what I think is right (they have no legal right to be here therefore they are trespassing) he will have President Bush, LaRaza and the ACLU after him. And of course they will immediately hmmm, what's the word, want to refile and take it to a higher court.
This is such an important case, if it goes thru that will give all other states (which I also understand are closely watching this) the ability to go after their illegals on the same grounds.
Also I read in a previous article regarding this that the Mexican government is paying legal fees for the illegals charged. I bet this judge wishes it wasn't happening in his court.
