The dissenting judges will be thinking like Democrats, that having a robe and a gavel is a roving commission to do whatever you think is a good idea, and never mind the Constitution. It is this precise difference which explains why the (no longer a "stealth candidate") John Roberts should and will be confirmed.
Thank you for posting this. Occasionally, judges speak in plain English that everyone can understand. These judges did that in this case.

(Will President Bush's SECOND appointment obey the Constitution? I give 95-5 odds on yes.)

Dear Lord, all that verbiage to talk around the fact that only the State Legislatures of the several States elect the President and Vice-President of the United States via the selection of Electors. The fact that citizens of the several States have been granted the ability by their respective State Legislatures is beside the point.
Heck, if the Florida State Legislature in the year 2000 Presidential election had been forced to forward the Bush slate of Electors to override any interference by the Florida State Supreme Court then it would have reaffirmed to an ignorant population that the citizen vote is not a right in Federal Elections for President/Vice-President.
These dissents which go off into the weeds about Treaty Law and the US Constitution have to prove that many law-school trained minds gets lost in the minutia to prove a point while losing the case. Very sad.
