"Pressed during his 2003 confirmation hearing for the appeals court for his own views on the matter, Roberts said: "Roe v. Wade is the settled law of the land. ... There's nothing in my personal views that would prevent me from fully and faithfully applying that precedent."

she's qualified, but 2 straight from the DC Circuit, if you count Ginsburg, that's 3 of the last 4. it just seems likely that they'd look elsewhere.

perhaps Bush chose Roberts to Pplease the Chief and is holding Brown for the first female/black Chief? it seems like a good stategy

The emphasis on Roe v Wade being the "law of the land" seems misplaced to me. But perhaps I'm missing something.

You are not missing anything, but to liberals Roe v. Wade is the Constitution. It can and it will be eventually overruled.

By the way, I wonder what Rehnquist, Scalia, and Thomas said regarding abortion in their confirmation hearings. Probably the same thing.

I think Rehnquist decented on Roe, so I doubt if he was even questioned on it.

FWIW:

On the Michael Medved show this afternoon (AM 1170 in San Diego) he related a conversation he'd had last night with Sandy Berger. They were both at Stanford University to debate, and the news about Roberts came through just before they went on. Berger heard the name and said "My God, he and I were partners at H & H" (law firm).

He told Medved that Roberts possesses a brilliant mind: " whatever meeting he was in, he was always the smartest guy in the room." But was also rather a humble man, with a lot of personal charm, and was a very decent person.

"Is he conservative?" asked Medved. "Oh, Very conservative" said Berger, "he would vote to overturn Roe vs. Wade". Berger further said (not happily :) that he expected there would be some resistance, but Roberts was pretty much a lock to be confirmed

So said Sandy Berger

The key here is the Rehnquist is hanging on until after this confirmation. He understands that there is only a few short years left in Mr. Bush's term and is a good bet that Stevens or Ruth Bader MIGHT also step down. Stevens is 85, although in good health. Once Roberts is confirmed its saves the nuclear option for Rehnquist and Mr. Bush can nail down the firebrand conservative to replace Rehnquist. Overall, its a great plan for the President. He is playing at least 2 moves ahead right now. Do you think this pick was a surprise for Rehnquist??? Handpicked is more like it.

I hope Sandy Berger's words come to pass.

The more conservatives that are appointed to the SC, the greater chance an opportunity will arise to overturn the abomination called, Roe v Wade.
