NY Times Statement on Judith Miller

"Ms. Miller learned about Valerie Plame from a confidential source or sources whose identity she continues to protect to this day. If the suggestion is that she is covering up for herself or some fictitious source, that is preposterous. Given that she is suffering in jail, it is also mean-spirited."

Cliff May was just interviewed on Fox.

He stated that, two days after the original Novak article, David Corn published some details of Plame's undercover CIA work that weren't mentioned in Novak's article. Corn's only attributed source for his article was none other than Joe Wilson himself.

that is true. it doesn't have to be this crime. she could use the 5th not just to deny answers to questions that would lead directly to conviction/indictment on this issue, but also to prevent answers that would help the prosecution build an evidence chain that would lead to her prosecution on something else. she could dance that line - "i'm not the leaker, but I am taking the 5th to prevent a chain of evidence being developed that could eventually lead back to me on something else".

I believe she could do that. But hell, I'm not Mark Levin.

not dirty pool if it's true.

Check out Rush Limbaugh, among others, for links to David Korn's article where it seems pretty clear that Wilson told Korn (hyperlib) that his wife was CIA.

Well, we know she's not "protecting" Rove, so the obvious conclusion is that the scumbag is protecting a member of her and her employer's party, ie., some big-name Democrat. This isn't rocket science....

I don't know about yours and others' speculation on this point. If one can believe the Washington Post on this particular, it seems to be that Fitzgerald wants to hear what Miller has to say about a government official:

Judges Order 2 Reporters to Testify on Leak (washingtonpost.com)

According to the appellate court's opinion, Fitzgerald knows the identity of the person with whom Miller spoke and wants to question her about her contact with that "specified government official" on or about July 6, 2003. Miller never wrote a story on the subject.

In a statement, Fitzgerald said: "We look forward to resuming our progress in this investigation and bringing it to a prompt conclusion."

I think a lot of people are letting their imaginations get too far ahead of the story. For one thing, Miller NEVER published Plame's name in public, so even if Plame were covert (and she wasn't) it would be moot, AFAIK.

one other thing, she should suffer in jail until she names the source, some short little stay is not enough of a deterrent apparently...

So Doug Thompson claims, but there are other possibilities, such as that he is merely another reporter who makes up sources when he wants...something that could also apply to Miller from what little she's said so far in her own defense.

But what I cant figure out is why this reporter would sit in jail to cover for this these people.

Because she knows that all she has to do is sit in there until the GJ expires (I recollect that was 4 months), then she doesn't have to tell anyone anything...UNLESS Fitzgerald decides to criminally prosecute her for obstruction, then she would have to do an additional 18 months. I wish he would, he has already brought the issue up once.

Good point, Sam. If Miller isn't the target of the investigation, then her 5th Amendment rights are meaningless. She can assert them on the stand, and the prosecutor could force her to testify by granting her immunity from prosecution.
