CIA 'outing' might fall short of crime

Can't excerpt but gist of article is that because the law against unmasking the identities of U.S. spies says a "covert agent" must have been on an overseas assignment "within the last five years" it would not apply here because Plame was assigned to Washington for greater than five years before the 2003 "leak". The assignment also must be long-term, not a short trip or temporary post, two experts on the law say. Victoria Toensing in the article and on today's Fox and Friends doubts Valerie Wilson, as she now refers to herself, qualified as a "covert agent" under that law. Toensing believes the ongoing federal investigation is not so much about the leak, but may involve perjury or obstruction of justice. In other words, though a crime may not have been committed at the start, one may have occurred during the investigation when someone lied to Fitzgerald or to a federal grand jury.

I hear Wilson was peddling his "Rove Must Go" story on Katie Colon's show this morning. The current story, by a member of the MSM no less, puts a different perspective on the whole affair, and Rove and the Bush administration may yet have the last laugh.

How do you LEAK something that's already public knowledge? This whole "scandal" just doesn't make any sense.

It's kinda hard to call yourself a "covert agent" when you're just a paper-pusher at Langley.

Looks like the MSM is pulling out their end game, i.e. "We couldn't stick this on Rove so let's end this quietly before it backfires and we get some on us."

This whole "scandal" just doesn't make any sense.

It makes complete sense when you look at it as an attempt to first smear Bush's Iraq War plans, then try to blame it on Rove when it backfires.

Wilson and his MSM co-conspirators make Dan Rather look like a genius.

The only scandal here is the DemonRats and the rabid Washington press corps believe they can throw enough rumors, innuendos, etc. at Rove, who they hate even more than Bush, that will stick. It is humorous to watch the story develop, with these one-track minds expanding each little tidbit to a full course meal. And each story spawns another with more fantasy and improbable scenarios. As Rush says, its fun to watch them self-destruct.

If the prosecuting attorney knows that elements of the crime cannot be proven, he/she is not going to bring a prosecution.

Sure it does, the government and media have nothing to offer the American people so they just go after each other daily to justify their existance and massive salaries and budgets.

It is what the do.

Fact is, the only way the MSM is even heard is by Rush and Laura and Hannity - I only hear MSM from them playing them.

Americans would not even hear it if not for the "right-wing" radio.

Anyone think to ask Wilson why he immediately accused Rove when this whole thing started? Or why his wife sent him to Niger? Or whether he actually did anything in Niger? Or why he wrote an article for the Times stating categorically that Saddam never sought yellow cake in Niger?

They seem to have gone balistic because the White House and/or GWB won't comment directly about this brouhaha but I'd love to ask them exactly how is the White House position on the Rove story any different than it was on the Sandy Berger investigation back in July of '04?

While it is clear to us here that these @$$-holes are merely trying to find ways to destroy GWB, to the rest of the world their actions create the impression that all of America is stupid, corrupt and/or petty beyond redemption!

Newsmax "scooped" them on it a few days ago...from my files:

She would have had to have been covert in the last five years for Rove to have broken the law, per former Assistant Deputy Attorney General Victoria Toensing, who helped draft the 1982 law in question.

For Plame's outing to have been illegal, the one-time deputy AG explained, "her status as undercover must be classified." Also, Plame "must have been assigned to duty outside the United States currently or in the past five years."
Facts:

Plame was not a covert agent. She had not been covert for nine years as she was outed by Aldrich Ames prior to 1994 and then again by the Cubans. She was assigned a desk job as an analyst at that time for her own safety.

The identity of CIA officer Valerie Plame was compromised twice before her name appeared in a news column that triggered a federal illegal-disclosure investigation, U.S. officials say.

Mrs. Plame's identity as an undercover CIA officer was first disclosed to Russia in the mid-1990s by a Moscow spy, said officials who spoke on the condition of anonymity. In a second compromise, officials said a more recent inadvertent disclosure resulted in references to Mrs. Plame in confidential documents sent by the CIA to the U.S. Interests Section of the Swiss Embassy in Havana.

The documents were supposed to be sealed from the Cuban government, but intelligence officials said the Cubans read the classified material and learned the secrets contained in them, the officials said.

The term "covert agent" means a present or retired officer or employee of an intelligence agency or a present or retired member of the Armed Forces assigned to duty with an intelligence agency whose identity as such an officer, employee, or member is classified information, and who is serving outside the United States or has within the last five years served outside the United States. 50 USC 426, Paragraph 4. (Emphasis added)

They heard the word "leak" and thought "water"gate. Its hard coded into their brains now. Never mind its merely a drip. Let them make fools out of themselves. Most people dont even know who Rove is or even care.
