From VA Beach, interrupting our 4th of July holiday weekend - as many are - to update Supreme Court wanna-be's list... Buzz in Capital is that O'Connor's replacement is right now a horse race between Cornyn, Garza and Clement. Out: Gonzales. It appears that Cornyn is the wildcard, with Garza the 'it' candidate for the time being. Falling: Roberts, Luttig. Situation is fluid, with the president not expected to pick a successor until after G8. Of note: White is thrilled to finally appoint a justice, but those in the know thought that it would be Chief Justice, and are surprised that it wasn't and isn't. ('candidate' links included)

Luttig harpooned Anita Hill. That's enough for me. The circus the Democrats would put on is more than worth the price of admission. That he happens to be a fine legal scholar and strict constructionist is lagniappe.

I love it. Garza has been my "gut" feeling for some time now and my political friends who are nervous just respond with a "WHO?" His bio looks good and the Marine Corps Captain impresses me alot. Just hope he's got the mudslinging armor on and ready to go. Any of these guys are just such fine people and don't deserve what's about to happen. He was confirmed in a little over a month to the 5th Circuit in 1991...anybody know who was in the majority in the Senate that year?

Since then Garza has developed a reliably conservative judicial record that includes criticism of the Roe V. Wade abortion decision of 1973. In 1997, Garza sided with the majority in upholding a lower court decision that struck down parts of a Louisiana law requiring parents to be notified when a minor child seeks an abortion. In his concurring opinion, however, he expressed doubts about whether Roe v. Wade was well-grounded in the Constitution.
"[I]n the absence of governing constitutional text, I believe that ontological issues such as abortion are more properly decided in the political and legislative arenas," Garza wrote. ". . . . [I]t is unclear to me that the [Supreme] Court itself still believes that abortion is a 'fundamental right' under the Fourteenth Amendment. . . ."

Thanks, have the bio with photo but can't find additional info...i.e. stances on important issues. Guess if the NOW gang starts squawking, I'll know right away. But then again, they squawk about anything Dubya does. Oh, by the way, how many members do they have "now"? Probably not enough to matter!

Cornyn may be much easier to confirm since he is a sitting senator. He might be a better choice in the future in case one of the leftists currently on the court creates a vacancy.

Garza's opinions are intelligent and well-reasoned. The main point, however, is the political consideration. By appointing a Hispanic to the Court, the President boosts his image (and that of the GOP) among Latinos.

I agree. Look at how they treated Aschcroft, supposedly one of the "club". I say he should go with Garza. I'd love to see those rich, privileged white liberals try to attack him. Bring it on!
