Unless it succeeds in rousing the public ire. What better to convince average dems to elect a congress that won't put up with this tyranny, to pressure sitting dems to okay W's choices.

If George Bush is so intent on "exporting democracy," maybe he should try exporting a little in Washington, DC. He can start in the chambers of the Supreme Court.

There is no longer "justice for all" either. Now it is only "due process." And from the "right to live" to the "right to own property," you don't have to be found guilty of a crime to lose this. You only have to receive the 'due process' that decides that your interests are of lesser value.

I agree with your characterization of our ruling junta as elites but this decision more closely resembles fascism then socialism. Socialism would imply that the state had claimed public ownership of the land but in this case it was forcibly transferred from one private owner to another.

While fascism is frequently equated to racism and used as a slur against conservatives when the left lacks a better argument, this is a bad misuse of the word.

Fascism is a political/economic system that combines totalitarian rule (complete with its disregard for individual rights) with directed partnership of and with free enterprise. Industry thrived under Hitler and the trains ran on time in Italy. This case which trampled the rights of an individual for the mutual benefit of the State and Industry looks a lot like fascism.

In this session the Supreme Court made three decisions regarding property rights. We have discussed the Kelo eminent domain case at length and its damage to individual real estate property rights. But they also decided that the cable industry was secure in its property rights and would not be required to share its cable infrastructure with competitors. And they made it easier for the music industry to protect their copyright property by opening the door to sue file swapping companies.

The message is clear. If you are a large taxpaying corporation which supports the elite junta your property rights are secure. But if you are just an average Joe Blow individual your property rights amount to a fart in the wind. It smacks of fascism!

I am not sure if the Supreme Court would have made this decision, if both parties had not already been bought and paid for. Al Capone is dead. Today's racketeers are politicians, lawyers, and lobbyists who do the dirty work of those who really have the money and power.

The government already essentially owns all land anyway. We just pay rent to live on it and build on it. This rent is called property tax.

Jim Quinn on his nationally syndicated radio show posed the following:

"At what point does tyranny imposed by a government morally justify the use of violence to overthrow that government."

I think at the current rate our government at all levels is trampling our constitution, the time is not far off. It may be time to start shooting the bastards. I'm sure the second amendment is next.
