Statement of Tom McClintock on SCOTUS Decision in Kelo (To introduce Constitutional Amendment)

Senator Tom McClintock released the following statement on the United States Supreme Court decision in Kelo v. City of New London, Connecticut.

McClintock to introduce an amendment to the California Constitution to restore the original meaning of the property protections in the Bill of Rights

“Today the U.S. Supreme Court broke the social compact by striking down one of Americans’ most fundamental rights. Their decision nullifies the Constitution’s Public Use clause and opens an era when the rich and powerful may use government to seize the property of ordinary citizens for private gain.”

“The responsibility now falls on the various states to reassert and restore the property rights of their citizens. I am today announcing my intention to introduce an amendment to the California Constitution to restore the original meaning of the property protections in the Bill of Rights. This amendment will require that the government must either own the property it seizes through eminent domain or guarantee the public the legal right to use the property. In addition, it will require that such property must be restored to the original owner or his rightful successor, if the government ceased to use it for the purpose of the eminent domain action.”

Great State Senator for California. Also ran an excellent campaign for governor but was bought out by the moderates and Schwarzenegger. His words ring true but I doubt the greedy liberals in the People's Republic of California will be willing to back such an amendment. Can we get it into the next special election or is it too late???

"I simply cannot tell you how often I have regretted voting for "The Equivocator" instead of Tom McClintock who was supposedly "unelectable". "

My son (in Glendale) voted for McClintock and he's more liberal than me.

He did run against Grey. The RAT (Bustamente) got 32%, Arnie got 49% and Tom got 14%. We could have had a conservative, but instead we got a RINO.

He's shooting too low. America needs him in a powerful position in Washington, preferably as president. If God continues to have mercy on America, we're going to need more like him in influential and powerful positions in Washington.

So you are going to let Walmart take your house without a fight? Just because the statists have a threadbare majority of one Supreme Court vote on the court now gives them no Constitutional right to abrogate our right to private property. The founders are rolling over in their graves today. If we let this go unchallenged, we are truly sheeple who deserve being fleeced by our minders in Washington DC.

Thank you for clearing this up.

No problem.

Tom McClintock is a treasure. Although I don't agree with him about everything, his writings are archetypal conservatism. If you want to read more over time, just ask calcowgirl to put you on her McClintock ping list.

I supported Tom in the recall. I'll support him in this too.

Even people I know who are liberals are shocked by this ruling.
