Stinks? Sucks?? That is far too mild. Private property rights in the country is now dead. Economic freedom cannot survive very long without private property rights.

This court is gotten so far out of line, it is almost treasonous. They are basing decisions on public opinion, on international law, on international opinion. What ever happened to basing decisions on THE CONSTITUTION??

This is very very serious and will have very serious implications for the future of this country.

And no, I do not think I am over-reacting.

I can gues how the 5-4 split went. Ginsberg, O'Connor, Souter, Stevens, Breyer on the side of allowing property to be seized for economic development and Rhenquist, Thomas, Kennedy, and Scalia against.

Rhenquist (80) will be the next to retire and them probably Stevens (85).

Property rights are not given explicitly in the Constitution. They are implicit only in the 4th and 5th Amendments. Property rights come through the State through the legal system.

I know yer not over-reacting ,... I'm chewing 16p nails I'm so mad ,... so,lemme get this straight?!!?? If I find a nice spot,buy it,and some developer thinks its nice also,he can get someone with "juice" in that jurisdiction to TAKE[reimburse,hahaha] my property??

We're all paying rent to the government for our so-called property, in the form of property taxes, so why is this so shocking or surprising?

Agreed. You are not overexaggerating. Now political contributers can get government to seize other people's private property.

I really blame George HW Bush [who appointed Souter] and the RINOs who were behind appointing Kennedy and evenJp Stevens and O'Connor. Why do we blow so manyopportunities to structure the court while the left gets Ginsburg and Breyer types --even when we control the Senate? The answer is RINOs like Orrin Hatch and other weak kneed phonies.

I don't think you're overreacting, the recently deceased Fifth Amendment read ".....nor shall private property be taken for public use, without just compensation".

(The homeowners had absolutely no desire to sell at any price)

Another out-of-control judicial horror!!
