I find O'Connor's dissent singularly unpersuasive. It's OK to condemn private property in Hawaii and give it to lessees because ownership was concentrated, and it's OK to fight blight because it is for the public good, including taking the unblighted within the blight area because it is part of a larger scheme, but it is not OK to take out a nice house which is holding up creating an office park which will serve demonstrated public purposes.

O'Connor's standard seems to be if it benefits the poor, or poorer, it is OK, and if it benefits the rich, or the richer, as she sees it through her mind's eye, it isn't.

Do you really find such an analysis persuasive as opposed to well, embarrassing?

In the following states, it is unlawful to seize homes: Arkansas, Florida, Illinois, Kentucky, Maine, Montana, South Carolina and Washington. So this decision does not apply to you if you own property there.
I guess we need to come up with a full list of all the states & how well vs. how badly they protect property rights. Then we can tell which states we need to focus on.

I'm trying and trying and I can't think of a darker day in the history of this country.

Waco would qualify IMO, but this certainly ranks. Or is Rank. Something to that effect. They discovered in Texas that they can murder with reckless abandon and no one will stand up to them. Why not take your house? There are no consequences to FedGov.

You seem to be missing my point, P-M.

If they take your property because WalMart can build a box store there and bring in a lot of taxes and provide a hundred jobs or so, there is only one question to ask.

Is WalMart a government entity?

If it is then it is a PUBLIC use. If it isn't, then the government is simply transferring property to a more preferred private or corporate entity.

With the court ruling, this may be needed to stand firm on judges. Not many know you can CALL ROVE'S OFFICE DIRECTLY (well, his assistant), bypassing the main switchboard. Tell Rove's office you support standing firm on this matter....and that it is high time to PRESENT A BLISTERING DEFENSE OF IRAQ POLICY and push for true tax reform, SS reform, and staying strong on judges. We need a conservative SCOTUS.

We (if I may speak for the left in general) have been freaking out thinking this current administration is leading to fascism, for quite some time. I say this only to let you know there are more than a few of us who feel that way.

You are correct in that this isn't a conservative vs. liberal issue. This is a libertarian vs. statist issue. Fascism is wrong on every level. I personally understand conservatism and am not in favor of gun control, I insist on the preservation of property rights, etc. It's just seemed like under GWB we've moved in a dangerous direction.

Anyway, I am not surprised both the DU thread and this thread read alike. Often I think there's just a misunderstanding and miscommunication between both sides. We're Americans first and foremost, irrespective of our political ideologies, IMHO. As such, we need to ensure we don't lose the principles this country was founded on. And I am glad you RWers have both guts and guns (some on the left do as well, although you'd never know it looking at most democrat politicians). Now, if we the people can just work together...

The politicians don't seem to be acting in our best interest, on either side, these days.

Well, you are misrepresenting O'Connor's position. Her position is that in Berman and Midkiff the status of the properties themselves had been deemed to cause public harm, and therefore the taking justified. In the present case, there was no argument that the properties themselves caused public harm.

But wait until they find out they can lose their homes so a new parking lot for the mall or a condo can be built to line the pockets of the developer and the city.

According to what was just on Neil Cavuto, it doesn't have to be a mall, condo or parking lot. It would simply be a matter of higher tax revenue.

Who/what is in the most danger????
CHURCHES - HOUSES OF WORSHIP!

They are tax exempt ... therefore, take the church and property, give it to an individual or 3, they build homes and pay taxes = increased revenue for the government. No eminent domain necessary.
