Double Murder Conviction for Man Who Helped Girlfriend Miscarry Tuesday, June 07, 2005 LUFKIN, Texas — A 19-year-old accused of causing his teenage girlfriend to miscarry two fetuses by stepping on her stomach was convicted Monday of two counts of murder. Gerardo Flores (search) received an automatic life sentence because prosecutors did not seek the death penalty, which was available under the state's 2003 fetus protection law (search). Erica Basoria, 17, acknowledged asking Flores to help end her pregnancy; she could not be prosecuted because of her legal right to abortion. The defense contended that Basoria punched herself while Flores was stepping on her, making it impossible to tell who caused the miscarriage. Basoria told authorities that, after about four months of pregnancy, she regretted not getting an abortion and started jogging and hitting herself to induce a miscarriage. When her efforts failed, she said she asked her boyfriend to help. Flores did not testify, but earlier told police that he stepped on Basoria's stomach several times during the week before she miscarried. Prosecutor Art Bauereiss said most of Basoria's family was pleased with the jury's decision. But Basoria, who sobbed as she left the Angelina County Courthouse, had stood by Flores. "It's just tragedy all around," said Flores' attorney, Ryan Deaton. Texas law defines an embryo or fetus as an "individual" and allows criminal prosecution or civil action for a preventable injury or death of a fetus. The law exempts health care providers who perform a legal medical procedure, such as an abortion.

So the man gets charged with double murder for helping his girlfriend have a miscarriage, but the pregnant woman gets over with no charge or conviction because she's protected by her legal right to have an abortion - even though she asked her boyfriend to help kill the babies. Am I missing something here or is this just another example of our asinine abortion laws and a judicial system that is going from bad to worse?

She couldn't be prosecuted for murder, due to the '73 babykiller rule, but couldn't she be charged with solicitation to commit murder?

Much as I favor fetus protection laws, since she desired for her pregnancy to end, as I understand it the law doesn't apply because it only applies to those intending to give birth... Methinks this may be thrown out on appeal (hope not, but the way i understand fetal protection laws it sounds like it will).

This is a good example of why laws against abortion are unenforceable and just won't work. The whole issue is much better left to persuasion rather than the feds.

Is there such a time period? I thought the courts have ruled that partial-birth abortion is legal and thus any abortion is legal?

Actually, this is a good example of why fetal protection laws defy all logic in an era when Roe v. Wade is considered the law of the land. This guy is guilty of nothing more than practicing "medicine" without a license, when you think about it.

The mental vision of a 19yr. old stomping on her, to kill the babies is just sickening.. It really is so sad that the birth of these babies would be so threatening.
