Article 1, Section 9 of the Constitution for the United States of America prohibits taxation of interstate commerce. Yes, however that is an article and section that was valid loooong before the constitution achieved living and breathing status.
After all to some rules were meant to break.

So, then the taxists invented the concept of "presence" out of whole cloth. If the company has a "presence" in your state, you pay sales tax as if the company were really selling to you locally.
That now expands to cover all internet sales. It's all an invention ex nihilo, but lawyers love doing that sort of stuff.
