DURHAM -- If people could be charged with walking while impaired by alcohol, Johnnie Patt Ndogo would have been a prime candidate Friday morning, court officials said.
They said Ndogo smelled of alcohol and stumbled when he appeared in traffic court to answer allegations that he failed to comply with penalties arising from an earlier drunken driving case.
So Ndogo, 55, was given a breath test. He registered a blood-alcohol concentration of 0.23, nearly three times the state's impairment standard of 0.08 and more than double the 0.10 he blew at the time of his DWI arrest.
Judge Marcia Morey promptly found Ndogo in contempt of court and jailed him for three days.
An inscription on Ndogo's keychain was read aloud to the courtroom audience, prompting a peal of laughter. It said: "Tomorrow I'll be sober and you'll still be ugly."
"I don't know what offended me more. His keychain or the fact that he came to court with more than double the limit [of alcohol]," Morey told The Herald-Sun later. "It was reprehensible. But I give him credit for providing the audience with some entertainment."
Assistant District Attorney Jim Dornfried said he saw Ndogo stumble in the courtroom.
"He clearly was appreciably impaired, although he did not appear to be what I would call falling-down drunk," Dornfried added.
Ndogo told court officials he had consumed the alcohol a day earlier, and also that a friend drove him to court Friday morning.
He wasn't believed.
"That wasn't feasible," said Dornfried. "He had to have been drinking right before he came to court. Otherwise, the alcohol in his system would have dissipated. I believe he drove himself to court, too. We're just fortunate no one was hurt."

A woman I helped arrest for OWI a couple years ago came to her pre-trial drunk and got 30 days for contempt (Oakland County, Michigan).
It said: "Tomorrow I'll be sober and you'll still be ugly."
In this case, the perp was ugly as sin and the judge was a hottie. The keychain would have made no sense.
